BEE KEEPING BY-LAW The Council o f the Oak Lake Sioux Band of Indians at a meeting held this 22nd day of August 1977 hereby enacts by-law number 15-77 to provide for the regulation of Bee keeping within the boundaries o f the Oak Lake Sioux Indian Reserve in the Province o f Manitoba. Whereas paragraphs (k) and (r) o f Section 81 o f the Indian Act empowers the Council o f a Band to provide for the regulation o f beekeeping and the imposition o f a penalty for a v io la tion thereof, and Whereas i t is deemed to be expedient to control the a c t iv it ie s o f beekeepers for the welfare and safety o f the inhabitants o f the Oak Lake Sioux Indian Reserve. Now therefore the Council of the Oak Lake Sioux Band of Indians enacts as a by-law thereof the follow ing: Iv In this by-law, (a) "Council" means the Council as defined in the Indian Act o f the Oak Lake Sioux Band of Indians; (b) "Reserve" means the tract o f land set apart by Her Majesty within the defin ition o f the Indian Act, for the use and benefit o f the Oak Lake Sioux Band of Indians known as the Oak Lake Sioux Reserve. (c) "Hives" means bee hives. 2. No person shall place or cause be placed hives upon the Reserve without the written consent o f the Chief and Council. 3. No person shall place or cause to be placed hives near a dwelling house without the occupants permission either expressed or implied. 4. No person shall without lawful excuse, the proof of which l ie s upon him, prowl or lo ite r by day or by night upon the s ite where hives are located. 5. The Band Council shall authorize the owner o f hives to place and maintain or cause to be placed or maintained warning signs indicating the distance and location o f hives. 6. No person shall in terfere with or attempt to in terfere with by removing, defacing, obliterating or altering any authorized bee signs within the Oak Lake Sioux Indian Reserve. 7. No person shall molest or destroy or attempt to molest hives within the Oak Lake Sioux Indian Reserve. 8. Any person who v io la tes any of the provisions of this by-law shall be gu ilty of an offence and shall be lia b le to a summary conviction to a fin e not exceeding 30 days or both fine and imprisonment.
