CONSTRUCTION BYLAW Council of the Buffalo Point Band Members at a meeting held this 7 day of July 1981 hereby enacts bylaw No. 8-81 to regulate the construction repair and the use of buildings, whether woned by the band or by individual members of the Buffalo Point Reserve. Whereas, paragraphs (h) and (r) of Section 81 of the Indian Act empowers the Council of a Band to make bylaws to provide for the regulation of the construction, repair, and use of buildings and the imposition of a penalty for a violation thereof, and, Whereas, it is deemed expedient and necessary to regulate and control the construction, repair, and use of buildings for the benefit of the Buffalo Point Re­ serve and its inhabitants. No therefore, the Council of the Buffalo Point Band Members enacts as a bylaw thereof, the following: 1. In this bylaw, (a) "Council" means the Council as defined in the Indian Act of the Buffalo Point Band Members ; (b) "Reserve" means the tract of land set apart by Her Majesty within the definition of the Indian Act, for the use and benefit of the Buffalo Point Band Members known as the Buffalo Point Reserve. (c) "Building" means any structure erected by the band or by an individual person for the purpose of a dwelling, or structure for the purpose of storing. (d) "Occupied land" means, ( i) any parcel of land that is held under lease or rent. (ii) any land that is used by an individual. (e) "National Building Code of Canada" means regulations as set out in accordance with the National Building Code of Canada 1960. (f) "Veranda" means outside area of cottage structure usually roofed and enclosed. (g) "Deck" means outside area of cottage structure, horizontal surface not enclosed. 2. (a) No person shall construct or attempt to construct a building on any occupied land without the Councils written permission. (b) Persons shall submit in duplicate to the Buffalo Point Development Corporation Ltd., prior to any commencement of any clearing or construction plans. (c) No person or persons shall commence with lot clearing or construction until the surveyor's pegs marking the boundary of the said lot are found, flagged and lines run to enable visual inspection of the lot. (d) The Lessee must flag or mark inside boundaries of the said lot as to indicate the ai'ea for the proposed cottage structure and drive­ way. (e) Each Lessee shall comply with boundaries as being Thirty-five (55) feet from front lot line, and Twenty (20) feet from sides and rear lot lines. (f) No person shall cut or permit to cut any living tree without prior approval from the Buffalo Point Development Corporation Ltd., for construction purposes or otherwise. (g) No person shall construct or attempt to construct a cottage structure of less than 600 square feet of ground floor living area, excluding verandas or decks. (h) Plans must include elevations, sections to walls, specifications for construction and exterior finishings.
CONSTRUCTION BYLAW Page 2 (i) Plans must be signed and a notation indicating the said indivi-, dual is aware that all construction meets the standards of the National Building Code of Canada. 3. No Building shall be erected within the boundaries of the Buffalo Point Reserve without proper planning and in consultation with the council of the Band. 4. No person shall repair to use or attempt to repair to use a vacant house without the written consent of the owner and in consultation with the Council. 5. No person shall paint the exterior of any structure in bright or loud colors , only soft colors or stains condusive to the park setting are permitted. 6. Any person who violates any of the provisions of this bylaw shall be guilty of an offence, and shall be liable on a summary conviction to a fine not exceeding one hundred dollars or imprisonment for a term not exceeding thirty days, or both fine and imprisonment.
