bJL Kb BYLAW imp Council of the Buffalo Point Band Members at a meeting held this 7 day of July,, 1981 hereby enacts bylaw No. 12-81 to provide for the fire protection within the boundaries of the Buffalo Point Reserve. Whereas, paragraph (a) and (r) of Section 81 of the Indian Act empowers the Council of a Band to make bylaws to provide for the health of residence on the Reserve and the imposition of a penalty for a violation thereof, and, Whereas, it is deemed to be expedient to control the out break of fire for the health and welfare of the inhabitants of the Buffalo Point Reserve. No therefore, the Council of the Buffalo Point Band Members enacts as a bylaw thereof, the following: 1. In this bylaw, (a) ’’Council means the Council as defined in the Indian Act of the Buffalo Point Band Members ; (b) "Reserve means the tract of land set apart by Her Majesty within the definition of the Indian Act, for the use and benefit of the Buffalo Point Band Members known as the Buffalo Point Reserve. (c) "Fire Prevention Officer means an individual appointed by the Band Council for the prevention and control of fires. (d) "Roof Space means a space under the roof. It is not an attic which is properly built with windows and stairs. (e) "C.S.A. Canadian Standards Association Electrical Code (C.S.A. 22.1 - 1966V means all electrical installations and wiring shall be according to the Electrical Code of the Province in which it is installed. (f) "C.S.A. Canadian Standards Association Installation Code (C.S.A. B139-1962)” means all equipment installed shall be according to the Installation Code of the Province in which it is installed. (g) "C.S.A. Canadian Standards Association Installation Code (C.S.A. B149-1966)” means all gas installations and piping shall be in­ stalled in accordance with the Installation Code of the Province in which it is installed. 2. (a) Every person shall be responsible to have in his/her dwelling place one five pound A-B-C dry chemical fire extinquisher ULC approved. (b) Each fire extinquisher shall be hung on the wall in the kitchen near the doorway to the outside, away from any stove. 3. (a) Newspapers, magazines, broken or unused furniture, old clothing, empty paint cans, bottles, broken glass and garbage shall not be allowed to collect in or around building. (b) Ashes shall be disposed of in a safe place at least 10 feet from any building or anything that will bum. (c) No container or obstacle shall block or obstruct any escape way from any building. (d) Every person shall obey "NO SMOKING" signs, he/she must not remove except on the instruction of the Fire Prevention Officer. 4. (a) No person shall store gasoline, oil and flammable liquids in plastic containers. (b) No person shall store gasoline, oil and flammable liquids in the rea of any dwelling place. (c) No person shall use gasoline, oil and flammable liquids for lighting fires in stoves, heating units or outside fires.

FIRE BYLAW Page 2 (d) Gasoline or oil lamps shall be filled outdoors in well ventilated areas, away from open flame or any tiling that can cause fire. 5. (a) Oil space heaters shall be placed on the floor and not closer than 12 inches from any wall made of material that will bum. (b) Oil burning equipment shall be installed in accordance with C.S.A. Installation Code B139-1962. 6. (a) A liquid propane cylinder shall be placed on level masonry or rigid supports at least 3 feet from any door or window. (b) Liquid propane cylinders shall not be installed or used inside any buildings. (c) The use of portable gas stoves inside a dwelling place or public place are not permitted unless the unit .is regulated from a high pressure capacity to a low pressure capacity. (d) All gas installations and piping shall be installed in accordance with C.S.A. Installation Code B149-1966. 7. (a) No more than two electric cords shall be connected to a double out­ let. (b) Electric cords for lights or lamps shall not be longer than 6 feet. (c) Electric cords shall not be run under rugs nor hung from metal brackets or supports. (d) Blown out fuses shall be replaced with new fuses of equal rating. (e) Large electric motors or equipment and automatic dryers shall be installed on separate circuits. (f) Only equipment tested and labelled by the Canada Standards Associa­ tion (C.S.A.) shall be used. (g) All electrical installations and wiring shall be according to the Canadian Electrical Code (C.S.A. 22.1-1966) or the Electrical Code of the Province in which it is installed. 8. (a) Owners of vacant buildings shall be responsible for them at all times. (b) Grass weeds and undergrowth shall be kept short for an area of 50 feet wide around all vacant buildings. (c) Windows, doors and all other openings which may provide entry shall be kept secure and boarded at all times. (d) Vacant buildings shall be kept free of newspapers, magazines, broken glass, bottles, broken furniture, old clothing and rags, empty paint cans, garbage and any other material that will bum. 9. (a) Roof spaces shall not be used for sleeping quarters, unless there are adequate means of escape. (b) Roof spaces shall not be used for the storage of bedding, newspapers, old furniture or other combustible materials. 10. (a) Trees and decorations shall not be exposed to direct heat or flame. (b) Trees shall not block an exit or an approach to an exit. (c) Trees shall be clear of curtains, drapes other hangings or wall coverings which can bum. (d) Trees shall be disposed of in the designated area known as the refuse dump.
FIRE BYLAW Page 3 11. (a) Stoves, furnaces and other heating units shall not block or restrict any escape from a room or a building. (b) Stoves or heating units (except oil space heaters) shall not be less than eighteen (18) inches from any wall made of material that will bum. 12. No person shall remove or cause to be removed any fire fighting equipment, unless for the use of fighting fire; and shall then refill and return equipment to the designated area for fire fighting equipment; notification to the Fire Prevention Officer shall be given immediately. 13. Any person who violates any of the provisions of this bylaw shall be guilty of an offence and shall be liable to a summary conviction of a fine not exceeding one hundred dollars or imprisonment for a term not exceeding one hundred dollars or imprisonment for a term not exceeding thirty days, or both fine and imprisonment.
