S '0 «> /77~ " St °-< ~ y ^ TRESPASSING BY-LAW The Council o f the B ird ta il Sioux Band o f Indians at a meeting held th is 22nd day o f August, 1977 hereby enacts by-law No* 13-77 to provide fo r the co n tro l o f the ir r e s p o n s ib le people who frequent or dw ell or purport to dwell on the B ird ta il Sioux Indian Reserve. Whereas; paragraphs (p) and (r ) o f S ection 81 o f the Indian Act empowers the Council o f a Band to make by-law s to provide fo r the rem edial a c t io n or removal o f persons tresp assin g upon the Reserve or frequenting the reserve fo r purposes other than fo r the b e n e f it o f the band community. And whereas; i t is deemed to be expedient and necessary to p ro h ib it c e r ta in persons from entering upon the B ird ta il Sioux Indian Reserve fo r the b e n e fit and com fort o f the in h a b itan ts . Now th e re fo re the Council o f the B ird ta il Sioux Band o f Indians enacts as a by-law th ereo f the fo llo w in g : 1. In th is by-law , (a) "C ou n cil" means the Council as defin ed in the Indian Act o f the B ir d ta il Sioux Band o f Indians; (b) "R eserve" means the tra c t o f land set apart by Her M ajesty w ith in the d e f in it io n o f the Indian A ct, fo r the use and b e n e fit o f the B ir d ta il Sioux Band o f Indians known as the B ir d ta il Sioux Reserve. ( c ) "C onstable" means a person appointed fo r the purpose o f m aintaining law and order on the Indian Reserve. 2. No person, other than a member o f the B ir d ta il Sioux Band o f Indians, or a person w ith w ritten a u th oriza tion pursuant to S ection 28 (2) o f the Indian Act sh a ll have the r ig h t o f a ccess to the B ird ta il Sioux Indian Reserve. 3. No unauthorized person sh a ll frequent or trespass on the Indian Reserve a fte r being n o t i f ie d in w ritin g by the Chief and Council that h e /sh e is p roh ib ited to enter the said Reserve. 4. No unauthorized person sh a ll remain in the Indian Reserve, more that hours a fte r re ce iv in g proper w ritten n o t ic e from Chief and C ouncil to vaca te the said Reserve. 5. Any person who v io la te s any o f the p rov is ion s o f th is by-law and S ection 30 o f the Indian Act sh a ll be g u ilty o f an o ffe n c e , and sh a ll be l i a b le to a summary co n v ic t io n to a f in e not exceeding $100.00 or imprisonment fo r a term not exceeding 30 days or both f in e and imprisonment.
