7 - / œ sg ' y fy 'y TRAFFIC BY-LAW The une i l o f the B ird ta il Sioux Band o f Indians at a meeting held th is 22 day o f August 1977 hereby enacts by-law No 5-77 to provide fo r the reg u la tion o f t r a f f i c w ith in the boundaries o f B ird ta il Sioux Reserve» Whereas, Paragraphs (b) and (r ) o f S ection 81 o f the Indian Act empowers the Council o f a Band to make by-law s resp ectin g the regu la tion s o f t r a f f i c and the im p osition o f a penalty fo r the v io la t io n th e re o f; And whereas i t i s deemed to be expedient to l im it the speed o f v e h ic le s on Reserve roads fo r the sa fe ty and w elfare o f inhabitants o f the B ird ta il Sioux Reserve. Now th e re fo re the Council o f the B ir d ta il Sioux Band o f Indians enacts as a by-law th ereo f the fo llo w in g : 1. In th is by-law , (a ) "C ou n cil” means the C ouncil, as defined in the Indian Act o f the B ir d ta il Sioux Band o f Indians; (b) "R eserve” means the tra c t o f land se t apart by Her M ajesty w ith in the d e f in it io n o f the Indian A ct, fo r the use and b e n e fit o f the B ir d ta il Sioux Band o f Indians known as the B ir d ta il Sioux Reserve. (c ) "Road" means an open way fo r the passage o f v e h ic le s , persons, and anim als, which includes b r id g es , drivew ays, s tr e e ts , v ia d u cts , t r e s t le s , thoroughfares or other p la ces set as id e f o r , used, or open to the P u blic fo r the passage o f v e h ic le s w ith in the Reserve. (d) "V e h ic le " means any wagon, c a r t , motor ca r , motor truck , t r a i l e r , m otor c y c le , tr a c t io n engine, t r a c to r , road making machinery or other conveyance that is d riven , p rop e lled or drawn by any kind o f power; and (e) "S ign" or " T r a f f ic s ign " means a s ig n , warning, marking or other d ev ice fo r the guidance or d ir e c t io n o f persons using the roads. 2. The d esig n , dimension and the e re c t io n o f t r a f f i c signs sh a ll meet the requirem ents as prepared by the Council on Uniform T r a ff ic Control D evices fo r Canada and the Canadian Good Roads A sso cia tio n . 3. (1 ) The Council s h a ll , by re s o lu t io n , au thorize the p lacin g o f a l l t r a f f i c signs and the re so lu t io n sh a ll s p e c ify the lo c a t io n and purpose o f the s ign . (2) The Adm inistrator sh a ll p la ce and m aintain or cause to be placed and m aintained, the signs authorized by the Council and sh a ll remove or cause to be removed, signs which are not authorized by the C ouncil. 4 . No person s h a ll in te r fe r e w ith or attempt to in te r fe r e w ith the placement o f maintenance o f any authorized t r a f f i c sign . 5. No person s h a ll remove, d e fa ce , o b l i t e r a t e , a lte r or attempt to remove, d e fa ce , o b l i t e r a t e , or a lt e r or in any manner in te r fe r e w ith any sign la w fu lly placed on a road. 6. No person sh a ll operate a v e h ic le on a road w ith in the Reserve at a ra te o f speed in excess o f the m iles per hour in d ica ted on the sign posted by order o f the Band C ou ncil. 7. No person s h a ll operate a v e h ic le on any road xvâthin the B ir d ta il Sioux Reserve, when he/she is not e l ig ib le to d r iv e by: (a ) not being a holder o f a v a lid d r iv e rs l ic e n s e as p rescribed by the Highway T r a f f ic Act o f Manitoba Sec (b) having th e ir l ic e n s e suspended or revoked under the Criminal code o f Canada Sec 8. No person sh a ll operate a v e h e ile on any road w ith in the B ir d ta il Sioux Reserve that i s , (a) not road worthy and considered in a dangerous or unsafe co n d it io n . (b ) not p rop erly lice n se d or insured as required by Highway T r a f f ic A ct, Province o f Manitoba. 9. No person sh a ll park or s ta tio n any v e h ic le upon any road in an unsafe in a n a e r i* o r a p e r i o d ..not t o ex c e ed 2 ho u r s *

The d r iv er o f any v e h ic le sh a ll comply with a l l t r a f f i c laws and regu la tion s in fo r c e from time to time in the Province o f Manitoba in which B ir d ta il Sioux Reserve i s s itu a ted . 11. Any person who v io la te s any o f the p rov is ion s o f th is by-law s h a ll be g u ilty o f an o f fe n c e , and sh a ll be l ia b le on summary co n v ic t io n to a f in e not exceeding $100.00 or imprisonment fo r a term not exceeding 30 days, or both f in e and imprisonment.
