PUBLIC WATER SUPPLY BY-LAW 1 Council of the B ird ta il Sioux Band o f Indians at a meeting held th is 22nd day o f August 1977 hereby en acts b y -la w number 4-77 to provide fo r the re g u la tion o f p u b lic water su pplies w ith in the boundaries o f the B ir d ta il Sioux Indian Reserve. Whereass paragraphs (a ) , (1 ) , and (r ) o f Section 81 o f the Indian Act empowers the Council o f a Band to make by-laws to provide fo r the regu la tion s o f the use o f p u b lic water su p p lies , and the im position o f a penalty fo r a v io la t io n th e re o f, and Whereas, i t i s deemed to be expedient to provide fo r the re g u la tion o f the use o f p u b lic water supplies fo r the h ea lth , sa fe ty and w elfare o f the inhabitants o f the B ir d ta il Sioux Indian Reserve. Now th e re fo re the Council o f the B ir d ta il Sioux Band o f Indians enacts as a by-law th e re o f, the fo llo w in g : 1. In th is by-law , (a ) "C ou n cil" means the Council as defin ed in the Indian Act o f the B ir d ta il Sioux Band o f Indians; (b ) "Reserve" means the tra c t o f land set apart by Her M ajesty w ith in the d e f in it io n o f the Indian A ct, fo r the use and b e n e fit o f the B ir d ta il Sioux Band o f Indians known as the B ir d ta il Sioux Reserve. (c ) "Prem ises" means lands and resid en ces w ith in the Reserve. 2. No person sh a ll w i l fu l ly or m a lic io u s ly p o llu te any w e ll , c is t e r n , r e se rv o ir or other water su p p lier w ith in the Indian Reserve, in the Province o f Manitoba. 3. No person sh a ll d estroy or damage any w e ll, c is t e r n , r e s e r v o ir , or other water su p p lier w ith in the Reserve. 4 . The occupant o f a premise w ith in the Reserve sh a ll keep any w e ll , c is t e r n o f re se rv o ir thereon p rop erly enclosed or covered. 5. No person sh a ll d ep osit in to or on the ic e o f or on the shores on any waters ly in g w ith in the Reserve any night s o i l , garbage, manure, dead animal m atter, decaying vegetab le matter or any substance or substance which in any way may contaminate such waters and tend to make the waters therefrom u n fit fo r human consumption. 6. Any person who v io la te s any o f the p rov is ion s o f th is by-law sh a ll be g u ilty o f an o ffe n c e and sh a ll be l i a b le on a summary co n v ic t io n to a f in e not exceeding $100.00 or imprisonment fo r a term not exceeding 30 days, or both f in e and imprisonment.
