NOXIOUS WEEDS BY-LAW A <3 - ; The Council o f the B ird ta il Sioux Band o f Indians at a meeting th is 22 day o f August, 1577 hereby enacts by-law number 16-77 provid ing fo r the d estru ction and co n tro l o f no: i s weeds w ith in the boundaries o f the B ird ta il Sioux Indian Reserve. Whereas, paragraphs ( j ) and (r ) o f S ection 81 o f the Indian Act empowers the Council o f a Band to make by-laws resp ectin g the d estru ction and co n tro l o f noxious weeds on the B ir d ta il Sioux Reserve fo r the w elfare o f the inhabitants th e re o f. Now th e re fo re the Council o f the B ird ta il Sioux Band o f Indians enacts as a by-law th e re o f, the fo llo w in g : 1. In th is by-law , (a) "C ou n cil" means the Council as defin ed in the Indian Act o f the B ir d ta il Sioux Band o f Indians; (b) "R eserve" means the tra c t o f land set apart by Her M ajesty w ith in the d e f in it io n o f the Indian A ct, fo r the use and b e n e fit o f the B ir d ta il Sioux Band o f Indians known as the B ir d ta il Sioux Reserve. (c ) "Noxious* Weed" means any p la n t, that is harm ful, damaging, in ju r io u s , deadly and u se less to man or dom estic v eg e ta tion . 2. The occupant o f any land w ith in the Reserve sh a ll cu t, or cause to be cut down, or otherw ise d estroy or cause to be destroyed a l l noxious weeds growing thereon as o fte n as may be necessary to prevent them from going to seed. 3. Any person who is a holder o f a c e r t i f i c a t e o f usership s h a ll cut or cause to be cut a l l noxious weeds growing in d itch es and on roads contiguous to land occu p ied . 4. Any person who is a holder o f a v a lid le a se s h a ll cut and d estroy or cause to be cut and destroyed a l l noxious weeds growing in d itch es and on roads contiguous to land leased . 5. The In spector sh a ll make p e r io d ic in sp ection o f the Reserve. 6. The In spector may g iv e w ritten n o t ic e to any occupant o f land w ith in the Reserve, requ irin g that person to destroy or have destroyed any noxious weeds on that land w ith in 7 days o f r e ce ip t by that person o f that n o t ic e . 7. An occupant, a le e s e e , or a holder o f a c e r t i f i c a t e o f usersh ip who re fu ses or n e g le cts to cut down or d estroy the noxious weeds w ith in the period o f 7 days sh a ll be g u ilty o f a breach o f th is by-law . 8. Any person who v io la te s any o f the p rov is ion s o f th is by-law s h a ll be g u ilty o f an o ffe n c e and sh a ll be l i a b le to a summary co n v ic t io n to a f in e not exceeding $100.00 or imprisonment fo r a term not exceeding 7 days or both f in e and imprisonment.
