s G y /y y — FIREARM BY-LAW & 1 7 T ' £ ~P~ '7 7 7 T Council o f the B ir d ta il Sioux Band o f Indians at a meeting held the 22nd day o f Au0^ st , 1977 hereby enacts by-law No* 6-77 to provide fo r the re g u la tio n o f firearm s w ith in the boundaries o f B ird ta il Sioux Indian Reserve* Whereas: paragraphs (c ) (d) and (r ) o f S ection 81 o f the Indian Act empowers the Council o f a Band to make by-law s resp ectin g the observance o f law and o rd er , the prevention o f d is o r d e r ly conduct and the im position o f a penalty fo r the v io la t io n th ereo f and Whereas; i t i s deemed to be expedient to lim it the manner o f usage and exposing o f firearm s on the reserve fo r the sa fe ty and w elfare o f inhabitants o f the Reserve. Now th e re fo re the Council o f the B ir d ta il Sioux Bànd o f Indians enact as a by-law th ereo f the fo llo w in g : 1. In th is by-law , (a) "C ou n cil11 means the Council as defined in the Indian Act o f the B ir d ta il Sioux Band o f Indians; (b) "R eserve" means the tra c t o f land set apart by Her M ajesty w ith in the d e f in it io n o f the Indian A ct, fo r the use and b e n e fit o f the B ir d ta il Sioux Band o f Indians known as the B ir d ta il Sioux Reserve* (c ) "Firearm " means any make or c a l ib r e o f r i f l e , shotgun, p i s t o l , handgun, and in th is by-law sh a ll in clu de a ir guns, BB guns, p e l le t guns and cro ss bows. (d ) "V e h ic le " means any wagon, c a r t , motor ca r , motor truck , t r a i l e r , m otor c y c le , t ra c to r or other conveyance that is d riven , p rop e lled or drawn by any kind o f power. 2. No person sh a ll carry a firearm concealed in h is /h e r a t t i r e w ith in the boundaries o f the B ir d ta il Sioux Indian Reserve. 3. A ll firearm s ca rr ied in a v e h ic le w ith in the B ird ta il Sioux Reserve s h a ll be kept inconspicuous at a l l times and in such a p la ce and manner that no person w i l l have immediate a cce ss . 4 . No person sh a ll upon any s t r e e t , road, or inhabited area w ith in the B ir d ta il Sioux Reserve d isch arge or attempt to d ischarge a firearm . 5. No person sh a ll on the B ir d ta il Sioux Indian Reserve a c tu a lly or apparently under 16 years o f age have in th e ir p ossession or be allow ed to handle or d isch arge or attempt to d ischarge a firearm w ithout adult su p erv ision . 6. Any person who v io la te s any o f the p rov is ion s o f th is by-law sh a ll be g u ilty o f ia n o f fe n c e and sh a ll be l i a b le to a summary co n v ic t io n to a f in e not exceeding $100.00 or imprisonment fo r a term not exceeding 30 days or both f in e and imprisonment. 7. A parent or guardian who permits h is /h e r ch ild or x^ard to v io la t e S ection 5 o f th is by-law sh a ll be g u ilty o f an o ffe n c e and shall, be l i a b le to a summary c o n v ic t io n pursuant to S ection 6 o f th is by-law .
