CONSTRUCTION BY-LAW Tu ̂ Council o f the B irdtail Sioux Band of Indians at a meeting held this 22nd day of August, 1977 hereby enacts by-law No, 11-77 to regulate the construction repair and the use of buildings, whether owned by the band or by individual members o f the B irdtail Sioux Indian Reserve. Whereas, paragraph (h) and (r) o f Section 81 of the Indian Act empowers the council o f a band to make by-laws to provide for the regulation of the construction, repair and use of buildings and the imposition of a penalty for a v io la tion thereof, and Whereas, i t is deemed expedient and necessary to regulate and control the construction: repair, and use of buildings for the benefit of the B irdtail Sioux Indian Reserve and its inhabitants. Now therefore .the Council of the B irdtail Band of Indians enacts as a by-law thereof the follow ing: 1. In this by-law, (a) "Council” means the Council as defined in the Indian Act of the B irdtail Sioux Band o f Indians. (b) "Reserve" means the tract o f land set apart by Her Majesty within the defin ition of the Indian Act, for the use and benefit of the B irdtail Sioux Band o f Indians known as the B irdtail Sioux Reserve. (c ) "Building" means any structure erected by the band or by an individual member for the purpose of a dwelling, store or shed. (d) "Occupied land" means ( i ) Any parcel of land that is held under lease or rent. ( i i ) Lots set aside by the Council for band projects or ( i i i ) Any land that is used by an individual Band member. 2. No person shall construct or attempt to construct a building on any occupied land without the occupants written permission. 3. No building shall be erected within the boundaries of the B irdtail Sioux Indian reserve without proper planning and in consultation with the Council of the Band. 4. No person shall repair to use or attempt to repair to use a vacant house without the written consent of the owner and in consultation with the Band Council. 5. Any person who v io lates any provision of this by-law shall be gu ilty o f an offence, and shall be lia b le on summary conviction to a fine not exceeding $100.00 or imprisonment for a term not exceeding 30 days, or both fin e and imprisonment.
