7 — / # / 3 POUND BY-LAW /f rp The Council o f the B ird ta il Sioux Band o f Indians at a meeting held th is 22nd day o f Au, t , 1977 hereby enacts by-law number 10-77 to provide fo r the re g u la tio n o f dom estic animals w ith in the boundaries o f the B ir d ta il Sioux Indian reserve . Whereas; paragraphs (e ) and (r ) o f s e c t io n 81 o f the Indian Act empowers the Council o f a Band to make by-laws to provide fo r the p ro te ct io n against and prevention o f trespass by c a t t le and other dom estic anim als, the establishm ent o f pounds, the appointment o f pound-keepers, the regu la tion s o f th e ir d u ties and the p ro v is ion fo r fe e s and charges fo r th e ir s e rv ice s and the im position o f a penalty fo r a v io la t io n th e re o f, and Whereas; i t is deemed to be expedient to provide fo r the reg u la tion o f cows or other dom estic animals fo r the p ro te ct io n o f property and the sa fe ty o f the inhabitants o f the Indian reserve . Now th ere fo re the Council o f the Band o f Indians enacts as a by-law the fo llo w in g : 1. In th is by-law : (a) "C ou n cil” means the Council as defined in the Indian Act o f the B ird ta il Sioux Band o f Indians. (b ) "Reserve" means the tra c t o f land set apart by Her M ajesty w ith in the d e f in it io n o f the Indian A ct, fo r the use and b e n e fit o f the B ir d ta il Sioux Band o f Indians known as the B ir d ta il Sioux Reserve. (c ) "Animal" means a dom estic animal and in clu des any h orse , cow, p ig , a ss , goa t, sheep, c a l f , b u llo ck , mule, s t a l l io n , b u l l , boar, or ja ck a ss . (d ) "Fence" means any enclosure made o f w ire , wood, ston e , or earth to keep animals in or ou t. (e ) "Pound" means an enclosure fo r the d eten tion o f s tray animals or o f d is tra in ed animals t i l l redeemed. ( f ) "Pound-keeper" means any person appointed by the Chief and Council fo r the purpose o f th is by-law . (g) "Run at la rg e " or "running at la rg e " means an animal that is o f f the premises o f i t s owner and i s not under e f fe c t iv e co n tro l o f some person or fen ce . (h) "Road" means highway, rou te , a l le y , path, causeway, s t r e e t , thoroughfare, or avenue. ( i ) "Crop" means wheat, o a ts , b a r le y , rape, f la x , m ille t or any dom estic p lan ts s p e c ia l or otherw ise. 2. The Council sh a ll appoint a pound-keeper fo r the Reserve who sh a ll hold o f f i c e during the term o f the C ouncil. 3 . The Council sh a ll e s ta b lish a pound book which sh a ll con ta in a l l p ertin en t in form ation perta in in g to the impoundment o f animals and sh a ll be kept by the pound-keeper which w il l at a l l times be open fo r in sp ection o f the Council or any member th e re o f. 4. The Council sh a ll e s ta b lish a p o lic y manual conta in ing the ru le s and regu la tion s to be en forced by the pound-keeper and the said manual sh a ll come under the ju r is d ic t io n o f th is by-law . 5. No person sh a ll a llow h is animals to run at la rg e on roads, crop s , gardens or in other peoples property . 6. Every owner o f an animal sh a ll e rect or cause to be erected a fen ce to c o n tro l h is /h e r animal and the said owner sh a ll be re sp on s ib le to m aintain that fen ce to p ro te c t h is /h e r property and the property o f o th ers . 7. No person sh a ll destroy or damage or attempt to destroy or damage a pound. 8. No person sh a ll in te r fe r e or attempt to in te r fe r e with a pound-keeper in the performance o f h is d u tie s . 9. No person sh a ll rescue or attempt to rescue any animal from the impounder or from the pound.

Any person who v io la te s any o f the p rov is ion s o f th is by-law s h a ll be g u ilty o f an o ffe n ce and sh a ll be l ia b le on a summary co n v ic t io n o f a f in e not exceeding $100.00 or imprisonment fo r a term not exceeding 30 days or both f in e and imprisonment.
