B Y -L A W NO. 1999 - 01 of the Sturgeon Lake First Nation a Bylaw for the Prevention of _______ Disorderly Conduct_______ E N A C T E D O N T H E /& D A Y O F A - 19 99 W H E R E A S the Council of the Sturgeon Lake First Nation desires to make a law governing the prevention of disorderly conduct, with respect to any matter ans yg out of Q grfr ancillary to the exercise of powers under Section 81 of the Indian A c t, ar for the imposition of a penalty for a violation thereof A N D W H E R E A S the Council ofthe Sturgeon Lake First Nation is empowered !o make such by-law pursuant to Paragraphs 81(1)(d), (q) and (r) of the Indian Act: A N D W H E R E A S it is considered to be expedient and necessary for the benel comfort and safety of the inhabitants of the Sturgeon Lake First Nation to provide for t e prevention of disorderly conduct on the Reserve; N O W T H E R E F O R E the Council of the Sturgeon Lake First Nation hereby ma es the following by-law: 1. Short Title: a) This by-law may be cited as the Disorderly Conduct By-law of the urgeon Lake First Nation (No. 360)". I 2. Interpretation: a) In this by-law: Band means the Sturgeon Lake First Nation; Council" means the Council of the Sturgeon Lake I irst Nation; Disorderly Conduct" means any act of behaviour, i rcluding: Fighting => Making or causing unreasonable noise =* Using abusive language => Using offensive or indecent gestures or displays => Being drunk => Loitering l -d 8 6 9 9 ' ON NO I D3d 1 V H 1 N 3 0 Hit 3N 6661
PAGE 2 => exposing, firing or discharging any gun, pistol or other firearms in a manner dangerous to people, livestock or property, using ori \ threatening to use any other article as a weapon. I j => Interfering in any manner with the orderly conduct of commercial, administrative, educational, recreational, health care, religious or ceremonial activities on the Reserve, or; Damaging or destroying the property of other people c/the Stt rgeon Lake First Nation, That disrupts public order on the Reserve, scandalizes the community, o causes public inconvenience, annoyance or alarm; Officer means any police officer, police constable of other person charcfed with the duty to preserve and.piaintain the public peace, and a by-law officer or any other person appointed by the Council for the purpose of rrtaintaining law and order on the Reserve; i Person" includes a corporation; Reserve" means the Reserves of the Sturgeon Lake First Nation (No. 360) and includes the Bands Reserves No. 101 and No. 101 A. f 3. Disorderly Conduct a) Everyone who commits an act of disorderly conduct is guilty of an o ense. b) An officer may order any person who is engaging in any disorderly >nduct to stop such conduct immediately. > 4. Enforcement a) Where as person who has been ordered to stop engag lg in disordt 1y conduct, fails or refuses to comply with the order, an of cer m ayiak i such reasonable measures as are necessary to stop the dis< rderly condi b) A person who fails or refuses to comply with an order n ade under s ibsection 3(2) or who resists or interferes with an officer acting ui der subsect >n 4(1), commits an offense. Penalty a) A person who commits an offense under this by-law is liable on sun mary conviction to a fine not exceeding one thousand dollars ($1,000.00) or to imprisonment for a term not exceeding thirty days, or to both.
