THE MILLBROOK BAND OF INDIANS BY-LAW NO. 31 Being a by-law to regulate the use of land. WHEREAS paragraphs 81(g), (h), and (r) of the Indian Act em­ powers the Council of the Band to make by-laws to provide for the dividing of the reserve or a portion thereof into zones, the prohibition of the construction of any class of building and the prohibition of any business, trade, or call­ ing within that zone, the regulation of the construction, repair and use of buildings, and the imposition of a penalty for a violation of such by-laws; AND WHEREAS it is considered expedient to control development on the Cole Harbour Indian Reserve pending the imposition of a comprehensive planning development; NOW THEREFORE, the Council of the Millbrook Band of Indians makes as a by-law thereof as follows: 1. In this by-law, (a) "Council11 means Council as defined in the Indian Act, of the Millbrook Band of Indians; and (b) "Reserve" means those tracts of land, the legal title to which is vested in her Majesty, that have been set apart by her Majesty for the use and bene­ fit of the Millbrook Band of Indians and known as the Cole Harbour Indian Reserve NO. 30. 2. The reserve is hereby designated as a "Wildlife and Re­ creational Zone". 3. No person shall construct, maintain or use any class of building within the "Wildlife and Recreational Zone" as defined in Section 2. 4. No person shall carry on any class of business, trade or calling within the "Wildlife and Recreational Zone" as defined in Section 2. 5. Any person who violates any provision of this by-law shall be guilty of an offence and shall be liable, on summary conviction, to a fine not exceeding one thousand dollars or the imprisonment for a term not exceeding thirty days or to both fine and imprisonment. 6. Where the by-law is contravened and a conviction entered, the court in which the conviction has been entered may make an order prohibiting the continuation or repetit­ ion of the offense by the person convicted. 1 of 2
