Whereas paragraphs (g), (h), (i), (q) and (r) of Section 81 of the Indian Act empower the Council of an Indian Band to make by-laws respecting the division, construction, maintenance together with necessary regulation, surveys and prohibition of such activities as well as other ancillary matters relating thereto including sanctions upon Summary Conviction; And Whereas Section 31 subsection (1) enables the Government of Canada to prevent unlawful occupation, possession and trespassing on Whycocomagh Indian Reserve // 2; Now Therefore the Council of the Whycocomagh Band of Indians enacts as a by-law thereof the following: 1. That in the event that the Government of Canada fails to act within ninety (90) days then the Council of the Whycocomagh Band shall evict pursuant to its powers under this by-law; 4. That the Government of Canada take steps to terminate all trespasses by non-Indians at Whycocomagh Indian Reserve // 2 within ninety (90) days; 5. In the event that the Government of Canada does not initiate steps within ninety (90) days then the Council of the Whycocomagh Indian Band shall serve ninety (90) days notice of the enforcemant of said Section 81 against non-Indians.
