t* S / WAGMATCOOK BAND OF INDIANS BY LAW 81 (a) No. 2 Being a By Law to provide for the protection of the water supply: Whereas paragraph (1) of Section 81 of the Indian Act empowers the Council of a band to make by laws respecting the construction and regulatio: of the use of public wells, cisterns, reservoirs, and other water supplies, and the imposition of a penalty for the violation thereof, and where as it is deemed necessary for the protection of the water supply of Wagmatcook, therefore, the Council of the Wagmatcook Band of Indians enacts as a By Law the following: 1. In the By Law: a) Council means the council (as defined in the Indian Act) of the Wagmatcook Band. b) System (1) The source of supply is a drilled well in the middle of trie north edge of the subdivision. System (2) The well is located on the edge of the main highway 300 m north of Humes Road intersection. System (3) The well is located near the shoreline of Bras d'Or Lake to the east of the Trans Canada Highway. It is 850 m in a i st nt r e a r i s g e h c t t i l o i n n . e (almost due south) from the Humes Road/T.C.H. c) Maintenance or improvements purposes shall be determined by Council or its agent. 2. No person at any time (save for maintenance or improvement) shall cause to be removed from the main water sources stations any manner of earthen material, rock or gravel. 3. No person at any time (save for maintenance or improvement) shall cause to be delivered, left, or dumped, any material or any form of refuse at the water sources stations. 4. The Wagmatcook Band Council or its agent may at their discretion erect signs indicating the actions prohibited herein and the penalty provided, and may create such barriers as may be deemed necessary by Council or its agent. 5.* Any person violating the preceding sections shall be liable upon summary conviction before a judge to a penalty not exceeding one hundred , dollars or imprisonment for a term not exceeding thirty days, or both, as provided in section (/< ) for a violation against section 81 of the Indian Act.
