C O U N C IL O F T H E Middle River FOR HEADQUARTERS USE ONLY BAND A G E N C Y Nova Scotia P R O V I N C E Nova Scotia P L A C E Margaree D A T E 3 0 October AD 1 Q 7 3 D A Y MONTH Y E A R DO H E R E B Y R E S O L V E : 7 t C <■ 3 To enact a by-law respecting the occupation and trespass by non-Indians of Margaree Indian Reserve # 25; and the loss of traditional use and occupancy of Margaree Indian Reserve # 25. Whereas paragraphs (g), (h), (i), (q) and (r) of Section 81 of the Indian Act empower the Council of an Indian Band to make by-laws respecting the division, construction, maintenance together with necessary regulation, surveys and prohibition of such activities as well as other ancillary matters relating thereto including sanctions upon Summary Conviction; And Whereas Section 31 subsection (1) enables the government of Canada to prevent unlawful occupation, possession and trespassing on Margaree Indian Reserve it 25; Nox? Therefore the Council of Middle River Band of Indians enacts as a by-law thereof the following: 1. That the Government of Canada evict all non-Indians from Margaree Indian Reserve # 25 without delay; 2. That notice of eviction be instituted against all non-Indians illegaly occupying Margaree Indian Reserve it 25 within (90) ninety days of the date of this resolution. That the event that the Government of Canada fails to act within ninety (90) days then the Council of the Middle River Band shall evict pursuant to its powers under this by-law; 4. That the Government of Canada take steps to terminate all trespasses by non-Indians at Margaree Indian Reserve # 25 x^ithin ninety (90) days; 5- In the event that the Government of Canada does not initiate steps within ninety (90) days then the Council of the Middle River Indian Band shall serve ninety (90) days notice, of the enforcement of said Section 81 against non-Indians.
