The C ouncil o f the Restigouche Indian Band a t a m eeting h eld t h is 16 day o f February, 1968, make the fo llo w in g by-law pursuant t o paragraphs ( c ) and (d ) o f s e c t io n 80 o f the Indian A ct. Ly-Law No. 15 A by -law t o provide f o r the observance o f law and ord er and f o r the prevention o f d is o r d e r ly conduct end nuisances on the R estigouche Indian Reserve in the Province o f Quebec. 1. In t h is by -law (a ) " s p e c ia l con sta b le " means a person appointed pursuant to s . 10 o f the Royal Canadian Mounted P o lic e A ct, R .S .C . 1959, c . 54 f o r the purpose o f m aintaining law and ord er on the R estigouche Indian R eserve; (b ) "p u b lic p la ce " in clu d es any p lace to which the p u b lic have a ccess as o f r ig h t o r by in v ita t io n express o r im p lied . 2. No person s h a ll cause a disturbance in o r near a p u b lic p la c e . (a ) by f ig h t in g , scream ing, shouting, sw earing, s in g in g , o r using in s u lt in g or obscene language; (b ) by bein g drunk, or ( c ) by impeding o r m olesting other persons. 3 . No person s h a ll openly expose o r e x h ib it an indecent e x h ib it io n in a p u b lic p la ce or commit any a ct in a p u b lic p lace which o ffen d s aga in st p u b lic decency o r ord er. 4. No person s h a ll l o i t e r in a p u b lic p la ce or in any way o b stru ct persons who are th e re . 5. No person s h a ll d istu rb the peace and qu iet o f the occupants o f a dw ellin g house by d ischarg ing fire -a rm s, or by other d is o r d e r ly conduct in a p u b lic p la ce , o r dw elling house. 6. No person s h a ll w ithout law fu l excuse, the p ro o f o f which l i e s upon him, prowl o r l o i t e r by day or by night upon the property o f another person near a dw elling houso s itu a ted on tliat p roperty w ithout the ow ner's p e m iss io n e ith e r express or im plied . « 2
I 7. The s p e c ia l con stab le s h a ll have the power and a u th or ity to a rre s t any persons who v io la te s any o f the p ro v is io n s o f th is by -law . 8. No person s h a ll r e s is t o r w i l fu l ly ob s tru ct a s p e c ia l con sta b le in the execu tion o f h is duty or any person la w fu lly a c t in g in a id ing such an o f f i c e r . 9« No person s h a ll omit without reasonable excuse to a s s is t a s p e c ia l constable in the execution o f h is duty in a rre s t in g a person o r in preservin g the peace a f t e r having reasonable n o t ic e th at he i s requ ired t o do s o . 10.
