By-law No. 2012/1 of the Kahkewistahaw Band A By-law to Amend Smoking By-law No. 2007/1 WHEREAS paragraphs 81(1) (a), (q) and (r) of the Indian Act, R.S.C. 1985, c.I-5, empowers the Council of a Band to enact a by-law to provide for the health of residents of the Kahkewistahaw Reserves, with respect to any matters arising out of or ancillary to the exercise of powers under section 81, and for the imposition of a penalty for a violation thereof; AND WHEREAS the Council of the Kahkewistahaw Band did enact By-law No. 2007/1 on the 17th day of July 2007 pursuant to paragraphs 81(a), (q) and (r) of the Indian Act, AND WHEREAS the Council of the Kahkewistahaw Band is of the opinion that By-law No. 2007/1 be amended in accordance with the terms of this by-law NOW THEREFORE the Council of the Kahkewistahaw Band makes the following by-law: Short Title 1. This by-law may be cited as the "A By-law to Amend the Kahkewistahaw Smoking By- Law”. Purpose 2. The purpose of this by-law is to amend the Kahkewistahaw Smoking By-law No. 2007/1 to prohibit Smoking in Bingo Establishments on Kahkewistahaw Reserves. Definition and Interpretation 3. Except as otherwise set out in this by-law, all terms that are defined in the Kahkewistahaw Smoking By-law No. 2007/1 shall have the same meaning in this by-law as in the Kahkewistahaw Smoking By-law No. 2007/1. Amendments to Smoking By-law 4. The Kahkewistahaw Smoking By-law No. 2007/1 is amended as follows: (a) The word and at the end of subsection 5(o) is removed, the period at the end of subsection 5(p) is removed, the phrase and is added at the end of subsection 5(p) and a new subsection (q) is added to the end of Section 5 as follows: “(q) Bingo establishments.” (b) Subsection 10(b) is removed.
This By-Law is hereby made at a duly convened meeting of the Council of the Kahkewistahaw Band this 2nd day of April, 2012. Voting in favour of the By-Law are the following members of the Council: Councillor Vera Wasacase Being the majority of those members of the Council of the Band present at the aforesaid meeting of the Council. The quorum of the Council is 3 members. Number of members of the Council present at the meeting was 4. I, Sheldon Taypotat, Chief of the Kahkewistahaw Band, do hereby certify that a true copy of the foregoing By-Law was mailed to the Minister of Aboriginal Affairs and Northern Development Canada at the AANDC Saskatchewan Regional offices of the department pursuant to subsection 82(1) of the Indian Act, this 3rd day of April, 2012. 2
