s ofi/ir 6 SARCEE INDIAN BAND ADMINISTRATION R R- 3, CALGARY, ALBERTA BUSINESS PHONE 281-4455 THE SARCEE BAND OF INDIANS BY-LAW NUMBER 7 Being a By-Law of the Sarcee Band of Indians to provide for the observance of law and order and for the prevention of disorderly conduct and nuisances WHEREAS paragraphs (c), (d) and (r) of Section 81 of the Indian Act Empower the Council of a Band to make By-Laws respecting the provisions for the observance of law and order and for the prevention of disorderly conduct and nuisances. . NOW THEREFORE THE COUNCIL OF THE SARCEE BAND INDIANS ENACT AS FOLLOWS: 1. This By-Law may be cited as a "Sarcee Indian Reserve Noise By-Law". 2. In this By-Law (1) "Sarcee Village" means that portion of the Sarcee Indian Reserve Number 145 as shown on the attached Plan to this By-Law. (2) "Public Places" shall mean any place within the Village site to which the public have access as a right or by invitation or implied. PURPOSE 3. It is the purpose of this By-Law to stipulate the conditions and requirements of persons being on public property. 4. No person shall cause a disturbance in or near a public place by (a) fighting, screaming, shouting, swearing or using
2 ( insulting or obscene language, (b) by being drunk.or (c) by impeding or molesting other persons. 5. No person shall expose or exhibit an indecent exhibi­ tion in a public place or commit any act in a public place which offends against public decency or order. 6. No person shall loiter in a public place or in any­ way obstruct persons who are there. 7. No person shall disturb the peace and quiet of the occupants of a dwelling house within the Sarcee Village, by discharging firearms or by any other disorderly conduct in a public place or dwelling house within the? Sarcee Village. 8. No person shall within the Sarcee Village, without lawful excuse or proof prowl or loiter by day or by_ night upon the property of another person or near the dwelling house situated on that property without the owner's permission either expressed or implied. 9. Any person who violates any provision of this By-Law shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding $100.00 or imprisonment for a term not exceeding 30 days or both for violation of a by-law made under this Section. 10. This By-Law repeals all previously enacted Sarcee Band Council By-Laws insofar as disturbing the peace and quiet of residents of the Sarcee Indian Reserve No. 145 is concerned. APPROVED AND PASSED at a duly convened meeting of the Council of the Sarcee Band of Indians this 16th day of July, 1975.
