SoA^7>' S"3C SARCEE INDIAN BAND ADMINISTRATION1 *" R.R. 3, CALGARY, ALBERTA BUSINESS PHONE 281-4455 THE SARCEE BAND OF INDIANS BY-LAW NUMBER 4 Being a By-Law of the Sarcee Band of Indians to prevent nuisances in the form of abandoned vehicles. WHEREAS paragraphs (b), (d), and (r) of Section 81 of the Indian Act empower the Council of a Band to make By-Laws respecting the regulation and control of nuisances in the form of abandoned vehicles and the imposition of a penalty by the violation thereof? ANEJ, WHEREAS it is expedient to control and regulate the abandonment of vehicles in the Sarcee Village. NOW THEREFORE THE COUNCIL OF THE SARCEE BAND OF INDIANS ENACTS AS A BY-LAW THEREON AS FOLLOWS? 1. This By-Law may be cited as a "Sarcee Indian Reserve Nuisance By-Law". 2. In this By-Law: (a) "Nuisance" means an abandoned vehicle? (b) "Sarcee Village" means that portion of the Sarcee Indian Reserve Number 145 as shown on the attached plan to the By-Law. /2
(c) "Inspector" means the person appointed from time to time by the Council pursuant to Section 2. 3. No person being the occupant of any land within "Sarcee Village" and the holder of a certificate of possession in respect of the said land within "Sarcee Village" even though he does not personally occupy the land or any agent, lessee, or occupier of the land shall permit abandoned vehicles to be or to remain on his land. 4. In any case where the Inspector reports an abandoned vehicle the person referred to in paragraph 3 shall remove the abandoned vehicle within five (5) days of the receipt of the written report. 5. An occupant or holder of a certificate of possession, whether in personal occupation of the land or not, who refuses or neglects to re­ move an abandoned vehicle within the period of five (5) days shall be guilty of a breach of this By-Law. 6. A person guilty of an infraction of this By-Law either in doing something which is prohibited by a provision of this By-Law or by refusing neglecting or failing to do something which he is required to do by a provision hereof is guilty of an offence- and is liable on summary con­ viction to a fine not exceeding the maximum of Fifty Dollars ($50.00) for which he is convicted and to costs including the costs of removing the abandoned vehicle, or in default of payment of such fine and costs to imprisonment not exceeding ten (10) days. 7. This By-Law repeals all previously enacted Sarcee Band Council By-Law insofar as abandoned vehicles on the Sarcee Indian Reserve No. 145 is concerned.
