S WG HI LD B AMD BY-LAW MO. 1-73 UPON MOTION DULY MADE BE IT RESOLVED that by the provisions of Section 81 (b) of the Indian Act Revised Statutes of Canada 1952 Chapter 149 and amendments thereto that: 1. The Provisions of the Highway Traffic Act of the Province of Alberta (1967, C30, S. l) AND THE REGULATIONS AND AMENDMENTS THERETO SHALL BE IN EFFECT ON THE SUNCHILD RESERVE. 2. THIS BY-LAW SHALL BE ENFORCED BY THE BAND CONSTABLE FOR THE. SUNCHILD RESERVE AND THE ROYAL CANADIAN MOUNTED POLICE. 3. FINES COLLECTED'* FROM THE ENFORCEMENT OF THIS BY-LAW SHALL BE SHARED EQUALLY BETWEEN THE SUNCHILD AND O'CHIESE BANDS. SUNGHILD BAND BY-LAW NO. 2-73 The Council of the Sunchild Band of Indians at a meeting held this 11th day of January 1973 make the the following by-law under paragraphs (d) and (or) Section 81 of the Indian Act, Revised Statutes of Canada 1952 Chapter 149 and amendments thereto 1. Any person who (a) has liquor in his possession (b) is intoxicated on the Sunchild Reserve is guilty of an offence and is liable on summary conviction to a fine not exceeding one hundred dollars or to imprisonment for a term not exceeding two months or to both fine and imprisonment® 2. (a) Whenever a Peace Officer believes, on reasonable grounds that an ̂ offence has been committed in respect to liquor, he may search for and seize those goods in relation to which he believes the offence was committed® (b) Where a person is convicted of an offence contrary to section 1 of this by-law, the presiding court may order the goods, by means of or in relation to which the offence was committed, in addition to any other penalty imposed, are forfeited to her Majesty. 3® Fines collected from the enforcement of this by-law shall be shared equally between the Sunchild and O'Chiese Bands.
