PAR LES PRÉSENTES: THAT the following By-Law be enacted: By-Law No. 4 Being a By-Law governing the construction, maintenance and regulation of outdoor adver­ tising signs WHEREAS Section 81(f), (g) and (r) of the Indian Act empowers the Council of a Band of Indians to enact by-laws respecting the construction and maintenance of water courses, roads, bridges, ditches, fences and other local works and any matter ancillary thereto and the imposition of a penalty for the violation thereof; and WHEREAS it is deemed expedient to regulate the construction, erection and maint­ enance of any sign as hereinafter defined on the Reserve; NOW THEREFORE the Council of the Stoney Band of Indians enacts as a by-law thereof as follows: 1. (a) "Tribal Administrator" means the person appointed to that position by the three Chiefs of the Stoney Tribe; (b) "Council"means the Council, as defined in the Indian Act, of the Stoney Band of Indians; (c) "Reserve" means the tract or tracts of land the legal title to which is vested in Her Majesty that has been set apart by Her Majesty for the use and benefit oT'the Stoney Band of Indians and known as the Stoney Indian Reserve Numbers 142, 142B, 143 and 144; (d) "road" includes any road, bridge, driveway, street, land, square, highway, avenue, parkway, trestle, thoroughfare or other place set aside for, used, or open to the public for the passage of vehicles within the Reserve; and (e) "occupant" mê ans the person who is the head of a household and occupying real property or a building on such real property, upon which a sign has been placed, located, constructed and erected thereon; (f) "sign" or "signs" means a sign, marking or other device for the adver­ tising of commercial products, goods or services either free standing or attached to and forming part of any building. 2. The Council shall, by resolution, designate the design, dimensions, const­ ruction and erection of any sign and authorize the placing and location of any such sign on a building or real property along, adjacent to or contig­ uous with any road. 3. The Tribal Administrator shall supervise the construction and erection or placing and maintaining of any sign and shall remove or cause to be removed any sign which is not authorized by the Council. 4. No person shall interfere with, or attempt to interfere with, the construction and erection, placement or maintenance of any sign authorized by the Council. , . . / 2

No person shall remove, deface, obliterate, alter or attempt to remove, deface, obliterate or alter or in any manner interfere with any sign auth­ orized by the Council. 6. (a) Subject to the provisions of paragraphs 6 (b) and (c) hereof, the occupant shall be entitled to receive ten percent of the funds received by Council for any sign and shall distribute any funds received to his or her relatives living in the building or on the real property uoon which any authorized sign has been placed in such amount as such occupant shall, in his or her sole discretion, determine. (b) The maximun amount payable by the Council to the occupant shall be five thousand dollars based upon ten percent of the funds received by the Council for any sign up to but not exceeding fifty thousand dollars. (c) If the Council receives funds in excess of fifty thousand dollars for any sign then the occupant shall not be entitled to receive any part or portion thereof and the funds received shall be the sole property of the Stoney Band of Indians. 7. Any person who violates any of the provisions of this By-Law shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding one hundred dollars or imprisonment for a term not exceeding thirty days or to both fine and imprisonment. f
