t>o£/ ys //£ o / / BY-LAW NO. 101 A by-law regarding the construction and maintenance of fences on the Sawridge Indian Reserve. K * WHEREAS the Indian A c t , R.S.C. 1970, as amended, provides that the Council of a band may make by-laws regarding the construction and maintenance of fences on a reserve) AND W H E R E A S the goals of the S a w r i d g e I n d i a n Band include the orderly development of the reserve to protect the health, safety and good order of the reserve; AND WHEREAS it is deemed expedient and in the interest of the general welfare of the Sawridge Indian Band to pass this o y - 1 aw j BE IT THEREFORE ENACTED as a by-law of the Sawridge Indian Band as follows: 1. This by-law may be cited as the "Sawridge Fencing B y - L a w " . 2. It is hereby authorized that the Band at its expense may fence the perimeters of the Sawridge Indian Reserve, attached hereto as Schedule "A to this By-law. 3. The type of Fencing used shall be sufficient to contain any livestock held on the said Reserve in the areas coned Open Space in the Sawridge Zoning By-law and shall also be sufficient to protect those areas of the OpenS pace zone used * or garden purposes from trespass by livestock. Any fencing erected shall be properly maintained to ensure that the above coals are achieved. 4. No person shall place any fence on any area of the reserve zoned as Energy Commercial or Open Space without the prior approval of the Sawridge Indian Band Council to ensure that any such fencing will not interfere with the lawful use of the lands and to ensure that the person placing the fence undertakes to properly maintain same at his expense. 5. Any p e r s o n c o n v i c t e d of a b r e a c h of S e c t i o n 4 of thisb y-law is guilty of an offence and is liable upon s u m m a r y c o n v i c t i o n to a fine not e x c e e d i n g $ 1,0 0 0 . 0 0 or imprisonment for a term not exceeding thirty days or both.
