PREAMBLE WHEREAS the Louis Bull Indian Band No. 138B is desirous of enacting a Bylaw respecting the provision of Police Services for the Louis Bull Indian Band No. 138B, AND WHEREAS the Indian Act, R.S.C. 1970, cl- 6, empowers the Council of the Band to make bylaws, NOW THEREFORE the Council of the Louis Bull Indian Band No. 138B, enacts as their bylaw the following: A BYLAW RESPECTING the Provision of Police Services at Louis Bull Band No. 138B. Section 1. LOUIS BULL POLICE DEPARTMENT There is hereby created a Police Department for the Louis Bull Indian Band No. 138B, which shall consist of Constables, one of which wsill de designated a Chief Constable and as many employees as the Band Council may designate from time to time. Section 2. APPOINTMENT AND REMOVAL OF CONSTABLES The Constables and Designated Chioef Constable and each other employee shall be appointed and terminated by Band Council Resolution of the Chief and Council. Section 3. POWERS AND DUTIES OF THE CONSTABLES The Chief Constable shall direct the Administration and Operations of the Police Department, and in addition to policies transmitted to him by th eBand Council, shall recom­ mend such other policies, directives, rules and regulations for the administration and operation of the Department as he sees fit.
2 The Constables and including the designated Chief Constable are responsible for providing a police service to the members of the Louis Bull Band 138B. The Constables and including the designated Chief Constable shall have the Special Duties of the prevention of disorderly conduct and nuisances, the observance of law and order, the preservation and maintenance of the public peace and enforcement of Band Bylaws and shall have generally all the powes and privileges, and be liable to all the duties and responsibilities which belong by law to constables duly appointed. AND further that the Constables shall, before entering upon his duties take and subscribe to an OATH in Form 1. FORM 1 I do swear that I will well and truly serve Her Majesty the Queen in the office of Con­ stable for the Louis Bull Band No. 138B with no favour or affection, malice or ill will, to the best of my power, cause the peace to be kept and preserv ed and prevent all offences against the person and properties of all persons, all Band properties wherever situated, and that I will to to the best of my skill and knowsledge discharge all the duties of my office faithfully and according to law. Section 4. AMENDMENT This bylaw shall be reviewed at least once annually and can be amended by quorum of Council, at a meeting called specifically for that purpose. Section 5. This bylaw shall come into force and effect on the date of final passing by Council. Read and passed for first reading this 28 day of May A.D. 1984.
