Soi? /s g - . 'H i BY-LAW NO. 101 '' A by-law regarding the construction and maintenance of fences on the Driftpile Indian Reserve. WHEREAS the Ind ian Act, R.S.C. 1970, as amended, provides that the Council of a band may make by-laws regarding the construction and maintenance of fences on a reserve; AND WHEREAS the goals of the Driftpile Indian Band include the orderly development of the reserve to protect the health, safety and good order of the reserve; AND WHEREAS it is deemed expedient and in the interest of the general welfare of the Driftpile Indian Band to pass this By-law: BE IT THEREFORE ENACTED as a by-law of the Driftpile Indian Band as follows: 1. This by-law may be cited as the "Driftpile Fencing By-Law". 2. It is hereby authorized that the Band at its expense may fence the perimeters of the Driftpile Indian Reserve, attached hereto as Schedule "A" to this By-law. 3. The type of Fencing used shall be sufficient to contain any livestock held on the said Reserve in the areas zoned Open Space in the Driftpile Zoning By-law and shall also be sufficient to protect those areas of the Open Space zone used for garden purposes from trespass by livestock. Any fencing erected shall be properly maintained to ensure that the above goals are achieved. 4. No person shall place any fence on any area of the reserve zoned as Energy Commercial or Open Space without the prior approval of the Driftpile Indian Band Council to ensure that any such fencing will not interfere with the lawful use of the lands and to ensure that the person placing the fence undertakes to properly maintain same at his expense. 5. Any person convicted of a breach of Section 4 of this by-law is guilty of an offence and is liable upon summary conviction to a fine not exceeding $1,000.00 or imprisonment for a term not exceeding thirty days or both. 5oR/S(o- M 4 Z_ 8Y-LAW NO. 103 A by-law regarding the destruction and control of noxious weeds on the Driftpile Indian Reserve. WHEREAS the Indian Act, R.S.C. 1970, as amended, provides that the Council of a band may make by-laws regarding the destruction and control of noxious weeds on the Reserve; AND WHEREAS the goals of the Driftpile Indian Band include the protection of the Reserve Lands; AND WHEREAS it is deemed expedient and in the interest of the general welfare of the Driftpile Indian Band to pass this By-law; BE IT THEREFORE ENACTED as a by-law of the Driftpile Indian Band as follows: 1. This by-law may be cited as the "Driftpile Weed Control ByLaw". 2. In this By-Law "destroy" means, with reference to a noxious weed, to kill all growing parts of the weed or render the reproductive mechanisms of the weed non-viable. 3. In this By-law "noxious weed" means a plant that is designated under the regulations of the Weed Control Act. R.S.A. 1970 and includes nuisance weed seeds, and the said regulations are hereby adopted as part of this By-Law. 4. No person shall knowingly bring onto the Reserve or place or permit to be placed on any part of the Reserve zoned as Open Space in the Driftpile Zoning By-law any noxious weed. 5. Any person convicted of a breach of any of the provisions of this by-law is guilty of an offence and is liable upon summary conviction to a fine not exceeding $100.00 or imprisonment for a term not exceeding thirty days or both. 6. The Council may appoint employees as inspectors for the purposes of this by-law and shall supply each inspector with a form of identification. 7. Upon an inspector finding any noxious weeds within any part of the Reserve zoned as Open Space in the Driftpile Zoning By-law, he shall forthwith have the noxious weeds destroyed.
