The Council of the Slaves of Upper Hay River Band of Indians at a meeting held this ^  day of » 1970 make the following by-law pursuant to paragraph (b) and paragraph (r) of Section Ô0 of the Indian Act. By-law No. 2 A by-law to provide for the regulation of traffic in the Indian Reserves of No. 207 Bushie River No. 209 Hay Lake No. 210 Zama Lake No. 211 Amber River No. 212 Upper Hay River No. 213 Bistcho Lake No. 214 Jackfish Point in the Province of Alberta. 1. In this by-law (a) "Council” means the Council of the Slaves of Upper Hay River Band of Indians; (b) "day-time" means the period commencing one hour before sunrise and ending one hour after the following suh c et; (c) "night-time" means the period commencing one hour after sunset and ending one hour before the following sunrise; (d) "Reserve” means the No. 207 Bushie River No. 209 Hay Lake No. 210 Zama Lake No. 211 Amber River No. 212 Upper Hay River No. 213 Bistcho Lake No. 214 Jackfish Point Indian Reserves;
2 (e) "Residential area" means any area in the Reserves designated din writing by the Council as a residential area for the purposes of this by-law; and without limiting the generality of the foregoing, includes Habay, Assumption and Upper Hay River; (f) "vehicle" means any wagon, cart, motor car, motor truck, trailer, motorcycle, traction engine, tractor, road-making machinery, power toboggan or other conveyance that is driven, propelled or drawn by any kind of power. 2. No vehicle shall be operated on the Reserve at a rate of speed in excess of 45 miles an hour during the day-time and 40 miles an hour during night-time. 3. Notwithstanding the provisions of Section 2 hereof, no vehicle shall be operated in any residential area at a rate of speed in excess of 20 miles an hour. 4. Notwithstanding any speed limit prescribed by or pursuant to this by-law, no vehicle shall be operated on the Reserve at any rate of speed that is unreasonable having regard to all the circumstances of the case, including without restricting the generality of the foregoing, (a) the nature, condition and use of the highway, (b) the atmospheric, weather or other conditions that might affect the visibility of the driver or the control of the vehicle, (c) the amount of traffic there then is or that might reasonably be expected to be on the highway,and (d) the mechanical condition of the vehicle or any equipment of the vehicle.
