ENOCH FIRST NATION TAX RATES BY-LAW 2015 WHEREAS pursuant to subsection 83(1) (a) of the Indian Act, R.S.C. 1985, c. I-5, the Council of a band may make by-laws for the purpose of taxation for local purposes of land, or interests in land, including rights to occupy, possess or use land in a reserve and with respect to any matter arising out of or ancillary to such purpose; and WHEREAS the Council of the Enoch Indian Band enacted the Enoch Band Taxation and Business Licensing By-law on September 15, 1986; THEREFORE BE IT RESOLVED that the following by-law be and is hereby enacted pursuant to the provisions of the Indian Act and in particular section 83(1) for the purpose of establishing annual rates of taxation. 1. This by-law may be cited for all purposes as the Enoch First Nation Tax Rates By-law 2015. 2. Pursuant to Section 22 (1) of the Enoch Band Taxation and Business Licensing By-law, the rate of tax multiplied by the assessed value of property shall be: Assessment Class Rate of Tax (a) for residential/farmland property 0.787 (b) for non-residential property (1) commercial 1.812 (2) industrial 1.102 (3) linear assessment 1.102 (c) machinery & equipment 1.102 (d) Neighbourhood Renewal Program 0.015 3. In the event that payment is not made when due then interest shall be charged at the rate of 10.0%. This by-law is hereby enacted by Council at a duly co ed meeting held on August 13, 2015.
