TZEACHTEN FIRST NATION PROPERTY TAXATION AMENDMENT LAW, 2012 WHEREAS: A. Pursuant to section 5 of the First Nations Fisct1 and Statisiic1 Alanagennnt .•ht (the Act”), the council of a First Nation may make laws respecting taxation for local purposes of reserve lands. interests in reserve lands or rights to occupy. possess or use reserve lands: B. The Tzeachten First Nation has applied to become a bolTo\ving member of the First Nations Finance Authority in order to access more favourable rates for bonowing to carry out infrastructure pro ects on Tzeachten First Nation reserve lands: C. Subsection 5(6) of the Act requires that the property taxation law of a borrowing member contain a requirement to recover amounts payable under paragraph 84(5)(b) of the Act: and D The Council of the Tzeachlcn First Nation has requested an exemption under subsections 6(2) and 8(2) of the Act from the Commission. NOW THEREFORE the Council of the Tzeachten First Nation, at a duly convened meeting. enacts as follows: Citation I. The Tzeaeluen First Nation Property Taxation Lout’, 20)0 is hereby amended by adding thc following new section: Special Levy 27.1 lfthe First Nation is at any time required, in accordance with paragraph 84(5)(b) of tile Act, to pay to the First Nations Finance Authority an amount sufficient to replenish the debt reserve fund, Council must make or amend such property taxation laws as necessary in order to recover tile amount payalle. Forcc and Effect 3. This Law comes into force and effect the day after it is approved by the First Nations Tax (OIllIiiissiOIl.
