Now· THEREFORE, the Council of the Westbank First-Nation hereby· enacts the following by-law; SHORT TITLE
l. This By-:-Iaw may be cited for all purposes as the IR No ;Q9 and No. l Q Development Services Vehicle Lease Purchase Project Capital Expenditure By--law No_..21-TX~OS.
EXPENDITURE AUJ1-IORIZATION
2. The W:estbank Fitst Nation hereby acknowledges that it is in the best interests of all community ~nd band members of the Westbank First Nation to proceed with the Development ServkesVehicle Lease Purchase Proj~ct as suminarizedin Schedule ''A" to this :By-law. 3. The. West.bank First Nation hereby approves the expenditure of not rriore·than Seventy Four Thousand Tl:rree Hundred Nineteen Dollars ($74,319;00) from the Contingency Fund.for the purposes of Development Services Vehicle Leases PI.Jfch.ase Project {the '"Project Funds"). 4. The.·westbankFirstNation also authorizes"the expenditure of all or a portion of the Project Funds tg acquire all ~uch lands, easements, rights-of-way, licences, permits, rights and.authorities·as-may be required or desirable for or in connecth;,i1 with the IR No.09 and No.10. To authorize the expenditure ofa maximum of Seventy Four Thousand Three Hundred and Ninet~e.n Dollars ($74,319.00)from·money raised pursuant to section 83(1) oft he Indian Act~ for the purpose of completing the Development. Services Vehicle Le~ses Purchase Projec;:t within the Tsinstikepfutn Indian Reserve N o.09 and No. l O. WHEREAS:
A. Pursuant to Section 83(1) oftheindianActand the Westbank First Nation's inherent right· of self-gqvernment~ the Westbank First Nation has enac;ted .the We stbank First Nation Property Taxation By-law, 95.;TX-08 (the "T=-xation By-.law");
B. In accordance with section 12(3)(m) oftheTaxation By,.Iaw, the Westbank First Natioi1 annually deposit;:; Ten ( 10%) pen;ent of 811llual gross· taxes in aµ income contingency fund (the "Contingency Fund") to be used frorn time to time for $Uch capital projects as may be authorized by separate by-law; C. In ac~mrdance with section4.4 ofthe WFN Expenditure By~law 1995,,,.all surplus monies remaining in the·Taxation·Fund at the end.of the Piscal Yeur specified in, the Expenditure By-law Annual Budget Schedule may be transferred foto the Stabilization Fund.,. and may b~ applied tpwards the operation and administration costs for the next Fiscal Year, overruns on existing Capital projects ot for any other contingencies, (the ''St11bilization Fund"); ·
D. Westbatik First Nation deems itdesirdble and in the·hest iriterestofthe community members tQ. advance funds tq. comp] ete the Development Services Vehicle, Lease Purchases Project on Tsinstikeptum Jndiart Reserve No.09 and No.10.
E. The West bank First Nation has concluded the total cost of Development Services Lease. Pu1·chase of the on Tsinstikeptum Indian Reserve No.09 and No.10 to be not more than Seventy Four Thousand Thre.e Hundred and Nineteen Dollars $74,319.00 as outlined in Sche.dule ~"A" to this By-law.

6, This By-law comes into full force and effectupcm approvalby the Minister of Jndigenous Affairs and N orthem Development Canada.
BE IT HEREBY RESOLVED AND AGREED:
That this By--law, entitled the "Ill N o.09 and No.10 ·P roject By-law No21-TX-05;' has been read for thefirst, second {if required), third and final time by the Council ofthe Westbartk First Nation at dtily convened council meetings.
