SQUAMISH NATION SENAKW CONSTRUCTION HOURS BY-LAW 2022 AMENDMENT BY-LAW 2023

SQUAMISH NATION SENAKW CONSTRUCTION HOURS BY-LAW 2022 AMENDMENT BY-LAW 2023

WHEREAS the Council of the Squamish Nation deems it to be in the best interests of the Squamish Nation to amend Squamish Nation Senakw Construction Hours By-law 2022 as set out herein.

NOW THEREFORE the Council of the Squamish Nation at a duly convened meeting of the Council assembled on the day of May, 2023, hereby enacts, pursuant to section 81(1) of the Indian Act, R.S.C. 1985, Chapter I-5, as a By-law the following:

Section 2 of the Squamish Nation Senakw Construction Hours By-law 2022 is amended by: (a) replacing the definition of “Chief Licence Inspector” in paragraph (a) with the following definition:

“Designated Entity” means the director of the Squamish Nation Planning and Capital Projects Department or such other individual as may be designated by Council, from time to time”; and

(b) renumbering paragraph (a) as paragraph (b); (c) renumbering paragraph (b) as paragraph (a) ; and (d) deleting paragraph (f). Section 5 of the Squamish Nation Senakw Construction Hours By-law 2022 is amended by replacing the words “Chief Licence Inspector” with the words “Designated Entity” wherever they appear in that section.

Paragraph 6(2)(d) of the Squamish Nation Senakw Construction Hours By-law 2022 is amended by replacing the words “the City of Vancouver City Noise Complaint telephone number” with the words “a telephone number to which noise complaints can be addressed”.

Section 7 of the Squamish Nation Senakw Construction Hours By-law 2022 is amended by replacing the words “City of Vancouver” with the words “Squamish Nation”.

Section 10 of the Squamish Nation Senakw Construction Hours By-law 2022 is replaced with the following:

“Every person who offends against or violates any of the provisions of this By-law or who suffers or permits anything to be done in contravention or violation of any of the provisions of this By-law is guilty of an offence punishable on summary conviction and

is liable to a fine of not more than $1,000.00 for each offence; and if the contravention is of a continuing nature is liable to a fine of not more than $1,000.00 for each day that offence continues.”. 2

Section 11 of the Squamish Nation Senakw Construction Hours By-law 2022 and the section title are deleted.

Section 12 of the Squamish Nation Senakw Construction Hours By-law 2022 is deleted. Schedule “A’ of the Squamish Nation Senakw Construction Hours By-law 2022 is amended by replacing the words “City of Vancouver Director of Licences and Inspections” with the words “Designated Entity”.

This By-law may be cited as the “SQUAMISH NATION SENAKW CONSTRUCTION HOURS BY-LAW 2022 AMENDMENT BY-LAW 2023”.
