Mathias Colomb Cree Nation TRESPASS LAW 2025 Enacted on MAY 15, 2025. Preamble A. Mathias Colomb Cree Nation wishes to exercise, through this law, its inherent rights of self-governance as well as its by-law powers under s. 81 of the Indian Act, RSC 1985, c 1-5; and
B.
The Council of Mathias Colomb Cree Nation wishes to pass this law, and repeal its predecessors, in the best interests of Mathias Colomb Cree Nation;
NOW THEREFORE the Council of Mathias Colomb Cree Nation enacts as follows: Citation 1. This law may be cited as the Mathias Colomb Cree Nation Trespassing Law, 2025. Interpretation 2. In this Trespass Law: a. "Council" means the duly elected Council of the Mathias Colomb Cree Nation, and includes the Chief and Councillors.

"Justice Committee" means the Justice Committee of Mathias Colomb Cree Nation as defined and governed by the of Mathias Colomb Cree Nation Justice Law, 2025, as may be amended or replaced.
"Location" means an area, building or structure on a Mathias Colomb Reserve owned, possessed, controlled or occupied by the Mathias Colomb Cree Nation or that is otherwise held in common by Mathias Colomb Cree Nation for the benefit of all Mathias Colomb Citizens.

"Mathias Colomb Citizen" means a person whose name appears on the Mathias Colomb Cree Nation membership list or citizenship list, or who is entitled to have his or her name appear on the Mathias Colomb Cree Nation membership or citizenship list, as determined by such law of Mathias Colomb Cree Nation with respect to membership or citizenship as may be in force from time to time, or if none, as determined by Mathias Colomb Cree Nation.
"Mathias Colomb Reserves" means the Pukawatagan Indian Reserve and all other reserves set aside the benefit of Mathias Colomb Cree Nation, and "Mathias Colomb Reserve" means any of them.
"Mathias Colomb Lands" means any lands within Mathias Colomb Cree Nation's traditional territory.
"Mathias Colomb Registered Trapline Holder" means a Mathias Colomb Citizen who has a Mathias Colomb Trapline registered in his or her name.
"Mathias Colomb Trapline" means any trapline registered to a Mathias Colomb Citizen.
"Notice of Trespass" means the Notice of Trespass form, attached under Schedule "A", issued to the person who is found to be Trespassing under Section 9.
"Officer" means a police officer, peace officer, First Nation Safety Officer authorized by Mathias Colomb Cree Nation, or other enforcement officer appointed by Mathias Colomb Cree Nation.
"Reside" means being resident in a dwelling or erecting a structure capable of being a dwelling in which one could be resident.
"Request for Review" means the Request for Review form, attached under Schedule "B", used to file a request to review a Notice of Trespass issued to a person who is found to be Trespassing under Section 9.
"Trespass" means, in accordance with the common law, the entry onto or presence on a Mathias Colomb Reserve, a Location on a Mathias Colomb Reserve, or a Mathias Colomb Trapline within Mathias Colomb Lands, by a person, without lawful authority or justification.
"Trespass Law" means this law, the Mathias Colomb Cree Nation Trespassing Law, 2025.
Nothing in this Trespass Law will infringe upon or diminish the constitutional rights of Mathias Colom Cree Nation or Mathias Colomb Citizens.

Mathias Colomb Reserves have been Set aside for Mathias Colomb Cree Nation's use and benefit, and, subject to this Trespass Law and any other law of Mathias Colomb Cree Nation, Mathias Colomb Reserves are intended for residence by those with valid entitlement to residency as provided under the Mathias Colomb Cree Nation Residency Law, 2025.
Council reserves the right to determine the Locations on Mathias Colomb Reserves that are appropriate for residential use and to regulate permissible uses in different Locations within Mathias Colomb Reserves through zoning, capital planning, Council resolutions, and other collective decision-making processes.
Protocol for Visitors to Reserve

Every visitor to a Mathias Colomb Reserve must report to the main office of Mathias Colomb Cree Nation upon arrival and register information about the length, nature and purpose of his or her visit, and contact information for the Mathias Colomb Citizen who invited him or her to a Mathias Colomb Reserve.
Grounds for Trespass on Reserve
7.
A person may be served with a Notice of Trespass under Section 9 for Trespass on a Mathias Colomb Reserve if they are:

residing on a Mathias Colomb Reserve contrary to the Mathias Colomb Cree Nation Residency Law, 2025, or residing in an unauthorized Location;
occupying a Location contrary to the purpose or function of that Location or contrary to Mathias Colomb Laws, policies or other rules applicable to that Location;
persons other than Mathias Colomb Citizens engaged in any activity on a Mathias Colomb Reserve that is prohibited by a provincial, federal, or Mathias Colomb Law, regulation or by-law;
non Mathias Colomb Citizens, persons with valid entitlement to residency as provided under the Mathias Colomb Cree Nation Residency Law, 2025, or employees of Mathias Colomb Cree Nation, who are on a Mathias Colomb Reserve, loitering, hawking or peddling wares or merchandise, soliciting financial assistance, harassing others, or engaging in any other behaviour deemed unwelcome by Council; or
reasonably deemed by Council to be:

threatening to the peace, health or safety of Mathias Colomb Cree Nation, Mathias Colomb Citizens or those lawfully on Mathias Colomb Reserves;
impeding the ability of Council to govern; or
impeding the ability of Mathias Colomb Cree Nation's employees or agents to effectively function.
For the purposes of Subsection 7(e), a person reasonably deemed to be threatening to peace, health or safety may include but is not limited to:

a person with a record of violent criminal offences, sexual criminal offences, and/or criminal offences against children; or
a person who is selling, producing, manufacturing or distributing illegal drugs or alcohol or importing them illegally to a Mathias Colomb Reserve;
and may include Mathias Colomb Citizens, residents, non Mathias Colomb Citizens and non-residents.
Procedure for Removal and Exclusion of Trespassers from Reserve

At any time, Council may, at a duly convened Council meet ing, pass a resolution authorizing a Notice of Trespass form attached under Schedule "A" to be served on a person who satisfies one or more grounds for Trespass under Section 7.

The Notice of Trespass will identify the ground(s) for Trespass under Section 7.
The Notice of Trespass shall indicate whether the person is required to vacate all Mathias Colomb Reserves or only a specific Location. If it is a Location, the Location will be identified.
The Notice of Trespass will identify the time by which the person must vacate Mathias Colomb Reserves or the Location, as the case may be, as follows:

If the person identified in the Notice of Trespass is believed to be residing in the Location in which they are Trespassing, the Notice of Trespass will give the person 14 days to vacate the location; or
In other circumstances (i.e. not involving residency), the Notice of Trespass will give the person 48 hours to vacate the Location.
The Notice of Trespass may require the person identified to remove any building or structure that they built, erected, deposited, left or installed on a Mathias Colomb Reserve without authorization within 30 days.

The Notice of Trespass will identify the procedure for the person identified in the notice to seek a review by Council under Section 12, and will identify whether or not the effect of the Notice of Trespass is suspended during the review process if a request for review is made.
The Notice of Trespass and a copy of this Trespass Law will be served on the person identified in the notice by an Officer, Council member, administrator, employee or agent of Mathias Colomb Cree Nation by personal service to the individual, or by delivery to their last known address by registered mail. A Notice of Trespass may be served within or outside Mathias Colomb Reserves.
A copy of the Notice of Trespass shall be delivered to the Justice Committee.
A person served with a Notice of Trespass must: a. vacate Mathias Colomb Reserves or the specified Location as required by the Notice of Trespass within the time indicated on the Notice of Trespass;
b.
c.
remove any building or structure required to be removed by the Notice of Trespass, within the time indicated on the Notice of Trespass; and
not enter or re-enter Mathias Colomb Reserves or the specified Location, as the case may be, as required by the Notice of Trespass, without written permission from Council.
Where only a specified Location has been identified in the Notice of Trespass, the person identified may enter the Location without Council permission if:

entry is necessary for the person to access services that the person requires, and the person gave Council at least 48 hours advance notice of their intent to enter the Location for that purpose; or
entry is necessary in an emergency situation.
Request for Review
12.
A person identified in a Notice of Trespass may, within 14 days of being served with the Notice of Trespass, request a meeting with Council to review the notice. In a review, the person may dispute the presence of valid grounds under Section 7 for issuing the Notice of Trespass, or may raise other arguments as to why the Notice of Trespass should be withdrawn or varied. The Request for Review must be made in writing, substantially in the form attached under Schedule "B", and delivered to the Justice Committee (documents may be delivered to the Justice Committee at the main office of Mathias Colomb Cree Nation). The Justice Committee shall be responsible for communicating the request to Council.

If a Request for Review under Section 12 is received 1 Council will convene a meeting to conduct the review, and will give the person named in the Notice of Trespass at least 7 days' notice of the meeting date.

The person identified in the Notice of Trespass is invited to attend the meeting, and may use a lawyer or other representative if they desire. In exceptional circumstances, where Section 16 applies, Council may require the person to participate by video rather than in person as not to violate the Notice of Trespass.
The person identified in the Notice of Trespass may provide evidence through witnesses and may give oral arguments. Council may ask other witnesses to give evidence. This portion of the meeting shall be public, unless Council decides to apply confidentiality restrictions for special reasons requiring confidentiality. If it is public, a written or video record shall be made.
Following the presentation of evidence and arguments, Council will deliberate its decision in private.
Following the meeting, Council will render a decision and may:

maintain the Notice of Trespass;
vary the Notice of Trespass; or
withdraw the Notice of Trespass.
The Council's decision will be communicated in writing, with reasons, to the person identified in the Notice of Trespass. If the Notice of Trespass was suspended during the review under Section 15, it takes effect again on the date the decision is communicated . Council will provide a new deadline for the person to vacate of at least 14 days for residency matters, and at least 48 hours for non-residency matters. If any building or structure must be removed, an updated date will be given at least 30 days after the decision.

Other than under Section 16, once a Request for Review under Section 12 has been received by the Council, the effect of the Notice of Trespass is suspended until a decision on the review has been made and communicated by Council under Section 14.
Where exceptional circumstances apply involving safety or other urgent considerations, and if the person identified in the Notice of Trespass is not currently residing in the place identified in the Notice of Trespass, Council may choose not to suspend the effect of the Notice of Trespass du ring the review process.
Enforcement level 1: Removal from Reserve

Officers are hereby authorized to enforce Notices of Trespass issued pursuant to this Trespassing Law that are in effect, and to use such reasonable measures as may be

necessary to remove the person from any Mathias Colomb Reserve or from a specified Location as the case may be, and to bar the person's entry. Any costs incurred in the removal of the person by air or by train may be charged to the person identified in the Notice of Trespass and is a debt recoverable to Mathias Colomb Cree Nation.
If a building or structure is required to be removed by a Notice of Trespass and is not removed by the deadline provided in the Notice of Trespass that is in effect, it may be removed at the direction of Council. Any costs incurred in the removal may be charged to the person identified in the Notice of Trespass and is a debt recoverable to Mathias Colomb Cree Nation.
Mathias Colomb Cree Nation, its Council, and all of its Officers, Councillors, employees, contractors, and agents have no liability whatsoever for any damage caused to a building or structure removed under Section 18.
Council may, by resolution, lift any Notice of Trespass completely or temporarily, and may provide any person with permission to enter, be present in, or Reside on Mathias Colomb Reserves, and shall communicate such resolutions to Officers and to the person identified in the Notice of Trespass.
TRESPASS ON A MATHIAS COLOMB TRAPLINE
Mathias Colomb Traplines

Mathias Colomb Traplines are an important part of Mathias Colomb Lands. They serve many important economic, cultural and other purposes for Mathias Colomb Registered Trapline Holders, Mathias Colomb Citizens, and the Mathias Colomb Cree Nation as a whole.
Each Mathias Colomb Registered Trapline Holder has special rights that may be exercised within his or her Mathias Colomb Trapline, including aboriginal and treaty rights, along with special responsibilities to care for that Mathias Colomb Trapline and safeguard it in the best interests of the land, water and animals, the person's extended family, and Mathias Colomb Cree Nation.
Protocol for Visitors to Traplines 23. Every visitor to a Mathias Colomb Trapline must seek out and obtain the advance permission of the Mathias Colomb Registered Trapline Holder before entering or making use of that Mathias Colomb Trapline.
Grounds for Trespass on Traplines 24. A person is deemed to be Trespassing on a Mathias Colomb Trapline and will be subject to removal and other enforcement under this Trespass Law for Trespass on a Mathias Colomb Trapline if the person is, or has done so within the past year:

causing a disturbance in a Mathias Colomb Trapline;
littering in a Mathias Colomb Trapline;
vandalising the property of the Mathias Colomb Registered Trapline Holder within the Mathias Colomb Trapline, or using the property without permission of the Mathias Colomb Registered Trapline Holder;
setting up, residing in, or keeping a camp or structure on a Mathias Colomb Trapline, without the permission of Mathias Colomb Cree Nation or the Mathias Colomb Registered Trapline Holder;
trapping, hunting, fishing or gathering in a Mathias Colomb Trapline without the permission of the registered trapline holder or a permit from Mathias Colomb Cree Nation; or
f . using a Mathias Colomb Trapline in a way that may cause damage; Procedure for Removal and Exclusion of Trespassers from Traplines
25.
If a person is trespassing on a Mathias Colomb Trapline in accordance with Section 24 above or has done so in the past year:

The Mathias Colomb Registered Trapline Holder, or a person authorized at their direction, may inform the person that:

they are Trespassing on the Mathias Colomb Trapline contrary to this Trespass Law;
they are required to leave immediately; and
they may be subject to ticketing or to being charged with an offence under this Trespass Law, or to both .
A person informed under Subsection 25(a), must immediately leave the Mathias Colomb Trapline and cease the activities that caused the Trespass.
If the Mathias Colomb Registered Trapline Holder has informed a person under Subsection 25(a), the Mathias Colomb Registered Trapline Holder will, within 1 week, inform the Justice Committee of the matter by completing the Information to Justice Committee (Trespass on a Trapline) form attached under Schedule "C" and delivering it to the Justice Committee's mailbox at the main office of Mathias Colomb Cree Nation.

The Justice Committee, having been informed under Subsection 25(c) will consider the need to inform other Officers of the matter for the purpose of ticket issuance or other enforcement.
The Mathias Colomb Registered Trapline Holder may contact a First Nations Safety Officer or other Officer for assistance at any time.
Enforcement Level 1: Removal from Traplines

Officers are hereby authorized to assist any Mathias Colomb Registered Trapline Holder in enforcing this Trespass Law and to keep peace and order on Mathias Colomb Traplines, and to use such reasonable measures as may be necessary to remove a person from a Mathias Colomb Trapline if the person is trespassing contrary to Section 24, or to bar their entry to the Mathias Colomb Trapline if they have Trespassed on that trapline contrary to Section 24 in the past year.
Every person who has Trespassed on a Mathias Colomb Trapline contrary to Section 24 must, at a time and in a manner arranged with the Mathias Colomb Registered Trapline Holder:

remove any litter they left on the Mathias Colomb Trapline;
repair any damage they caused to the Mathias Colomb Trapline, including damage to property; and
remove any building or structure they built or caused to be built on the Mathias Colomb Trap line without the permission of the Mathias Colomb Registered Trapline Holder or of Mathias Colomb Cree Nation;
and if the person does not comply with this Section 27 in a reasonable and timely manner, the Mathias Colomb Registered Trapline Holder may take those actions himself or herself to restore the Mathias Colomb Trapline. Any cost of doing so is a debt recoverable by the Mathias Colomb Registered Trapline Holder from the person who did not comply.

The Mathias Colomb Registered Trapline Holder and its agents and contractors, and Mathias Colomb Cree Nation, its Council, and all its Officers, councillors, employees, contractors, and agents, have no liability for any damage caused by an action taken under Section 27.

If a person has been found by an Officer to be in violation of this Trespass Law, an Officer may issue a ticket to the individual specifying a fee in the amount set out in Schedule "D".

A person who has been issued a ticket must pay the ticket fee to the Mathias Colomb Cree Nation within 30 days.
The Mathias Colomb Cree Nation must issue a receipt upon payment.
Enforcement Level 3: Offences

A person who does not comply with a Notice of Trespass issued under Section 9 that is in effect, and that was served on them or reasonable efforts were made to serve it on them, commits an offence punishable on summary conviction for a fine up to $1,000 or to imprisonment for up to 30 days, or to both.
A person who does not comply with Section 25.b) or Section 27 of this Trespass Law commits an offence punishable on summary conviction for a fine up to $1,000 or to imprisonment for up to of 30 days, or to both.
Repeal and Transitional 32. All prior trespass laws of Mathias Colomb Cree Nation, including by-laws, and including By-law No. 6 of the Mathias Colomb Band, a By-law for the removal and punishment of persons trespassing or frequenting the reserve for a prohibited purpose, are hereby repealed and replaced with this law.

Every resolution, notice or other document issued under a former trespass law of Mathias Colomb Cree Nation remains effective, and may be enforced by any Officer.
A person who breaches a resolution, notice or other document issued under a former trespass law of Mathias Colomb Cree Nation, including a by-law, commits an offence punishable on summary conviction for a fine up to $1,000 or to imprisonment for up to 30 days, or to both .
Any resolution, notice or other document issued under a former trespass law of Mathias Colomb Cree Nation may be varied or withdrawn by Council under section 20 of this by law.

If any part of this Trespass Law is found to be invalid or unenforceable, the section affected will be read down to eliminate the impugned portion, and the remainder of this Trespass Law will remain in force.
Schedules

The Schedules, being the Notice of Trespass, attached under Schedule "A", Request for Review, attached under Schedule "B 11 , Information to Justice Committee (Trespass on a Trapline}, attached under Schedule "C", and Ticket Fees, attached under Schedule "D 11 , form part of this Trespass Law and may be amended by resolution of the Council.
Coming into force 38. This Trespass Law comes into force after it is enacted by the Council of Mathias Colomb Cree Nation, on the date it is first published on the Mathias Colomb Cree Nation website, in the First Nations Gazette, or in a newspaper that has general circulation on the Mathias Colomb Reserves, whichever the Council considers appropriate in the circumstances ..
