MISSISSAUGA FIRST NATION OFF-ROAD VEHICLE LAW URGENT APPROVAL SEPTEMBER 24TH 2025 Whereas the Mississauga First Nation have the inherent right given by the Creator to enact any law necessary in order to protect and preserve our Anishinaabe culture, to protect our lands, our language, customs, traditions, practices and people;
And Whereas the Mississauga First Nation has entered into the Framework Agreement on First Nation Land Management with Canada (February 12, 1996, as amended: the "Framework Agreement"), which was ratified on behalf of the Government of Canada by the First Nations Land Management Act (1999);
And Whereas the Mississauga First Nation ratified the Framework Agreement and brought its Land Code into effect on August 1, 2009;
And Whereas, pursuant to the Mississauga Land Code, laws may be enacted to protect Mississauga Land, the use and benefit of Mississauga Land, the occupation of Mississauga Land, residence on Mississauga Land, and the creation of offences, penalties and remedies for violations of Mississauga laws; and
And Whereas the Council of Mississauga First Nation is empowered to make this law pursuant to s. 81.(1) (b), (c), (d), (m), (p), (q) and (r) of the Indian Act;
And Whereas the Chief & Council of Mississauga First Nation deems it advisable and in the best interests of Mississauga First Nation to enact a Law to regulate the use of ATV's (All Terrain Vehicles), UTV's (Utility Task Vehicles) with four wheels as well as Snowmobiles and snowmobiles with tracks;
And Whereas the Council of the Mississauga First Nation deems it in the best public interest to regulate, govern or prohibit the operation of off-road vehicles within the community.
NOW THEREFORE the Council of the Mississauga First Nation enacts this Off-Road Vehicle Regulation Law.

DEFINITIONS 1. In this Law:
Off-road Vehicle
Council

means an All-terrain vehicle (ATV) that, a) has four wheels which have all tires in contact with the ground b) has handlebars used for steering c) has a seat that is straddled d) is designed to carry only the driver and no more than one passenger means an Extreme Terrain Vehicle that, a) has six or eight wheels which have all tires m contact with the ground b) has no tracks that are in contact with the ground c) has seats that are not to be straddled d) has a minimum cargo capacity of 159 kilograms means a Multi-purpose off-road utility vehicle, a) has four wheels which have all tires in contact with the ground b) has a steering wheel for steering control c) has seats not designed to be straddled d) has a minimum cargo capacity of 159 kilograms means an Off-road motorcycle that, a) has steering handlebars b) has two wheels which have all tires in contact with the ground c) has a minimum wheel rim diameter of 250 millimetres d) has a minimum wheelbase of 1,016 millimetres e) has a seat designed to be straddled by the driver f) is designed to carry only the drive and no passenger g) does not have a sidecar means a Recreational off-highway vehicle, a) has four or more wheels with all tires in contact with the ground b) has a steering wheel for steering control c) has seats that are not designed to be straddled d) has an engine displacement equal to or less than 1,000 cubic centimetres. means the body composed of those individuals elected pursuant to the Mississauga First Nation Election Code,
means the person or persons appointed by Council, from time to time, to administer and enforce the provisions of the

Mississauga First Nation's laws including First Nation Constables,
Mississauga First Nation Land means any First Nation reserve lands in which all members have a common interest and any lands that may be added to the reserve in the future,
Street, highway, and laneway
Snowmobile
means a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct, or trestle, of which is intended for or used by the general public for the passage of vehicles and includes the lateral property lines thereof, and
means a motorized vehicle meant for travel over snow, especially one with runners in the front and tracks in the back.
RESTRICTIONS
2. Off-road vehicles and snowmobiles shall be prohibited from traveling in, over or upon the following streets between the hours of 11 :00 p.m. to 6:00 a.m. daily within Mississauga First Nation and the said streets shall hereinafter be referred to as restricted streets, namely:
a) The Village Road Walking Path from 154 Village Road to Ella Drive b) Village Road, East Street, West Street, Park Road and Sawmill Road of the main village c) Eli Street, Ella Drive and Bonekeosh Street of the new subdivision
3. No person shall operate an off-road vehicle or snowmobile at any time, over or upon the following areas, namely:
a) On any land occupied by a member without the occupant's consent b) The Mississauga First Nation Daycare and surrounding area c) Mississauga Gitigan d) Water Treatment Plant area e) Public Works Yard f) Mississaugi Women's Shelter g) Dreamcatcher Baseball Fields h) Mike & Molly Chiblow Playground i) Ella Drive playground and Bonekeosh basketball court j) All other parks and playgrounds within the Mississauga First Nation k) All public beaches within the Mississauga First Nation 1) All cemeteries within the Mississauga First Nation

m) Powwow Grounds
4. Off-road vehicles and snowmobiles may drive along, upon, or across public roads or highway within the designated urban area of the Mississauga First Nation, except where specifically prohibited in Section 2.
5. Off-road vehicles and snowmobiles may only cross restricted streets in the following manner: a) The operator shall stop the vehicle at the edge of the road or street b) The operators shall ensure that it is safe to cross the road or street c) When it is safe, the vehicle shall then drive the vehicle directly across the said restricted street or road in a manner that is perpendicular to the course of the street or road
6. The operator of an off-road vehicle or snowmobile shall: a) Ensure that when towing a trailing device that the said trailing device shall be equipped with a rigid hitch and shall be fastened to the vehicle, and which does not obscure any break or signal lights on the vehicle
SPEED LIMITS
7. All off-road vehicles and snowmobiles are to observe the speed limit of20 kilometres per hour within the urban area of the Mississauga First Nation.
OFFENCES
8. Under this law a person commits an office who: a) Fails or refuses to comply with any provision in this By-law b) Submits false or misleading information to the By-law Officer or any delegated authority
PENALTIES
9. A person who commits an offence under this By-law is liable on summary conviction to the following fines or community service: a) 1 st offence - $100 or 20 hours of community service b) 2 nd offence - $300 or 30 hours of community service c) 3 rd offence - $500 or 40 hours of community service

DO HEREBY RESOLVE: WHEREAS the Mississauga First Nation exercises its inherent and treaty rights to govern and enact laws for the protection and well-being of its people, lands, and community;
AND WHEREAS Mississauga First Nation is a signatory to the Framework Agreement on First Nation Land Management and enacted its Land Code on August 1, 2009, enabling the Nation to pass laws in accordance with its own governance and the Misswezahging Constitution;
AND WHEREAS Chief and Council deem it in the best interests of the Mississauga First Nation to regulate the use of off-road vehicles and snowmobiles in order to protect public safety, land, infrastructure, and cultural spaces;
THEREFORE BE IT RESOLVED THAT Chief and Council hereby approve and enact Off-Road Vehicle Law as presented, effective immediately upon this resolution under the Mississaga First Nation Land Code;
BE IT FURTHER RESOLVED THAT the law shall be administered and enforced in accordance with its terms, including through the appointment of Enforcement Officers as designated by Council.
