‘odl/Qi-Uz. THE STONY RAPIDS BAND OF INDIANS By-Law 1.77 Being a by-law to regulate the use of snowmobiles within the community of Black Lake, Saskatchewan. Whereas, Section 82 (a), (b), (c), (d) and (r) of the Indian Act empowers the Council of an Indian Band to enact by-laws respecting the regulations of traffic, the observance of law and order, the prevention of disorderly conduct and nuisances, and to impose a penalty for violation thereof; And Whereas, the Council of the Stony Rapids Band of Indians is of the opinion that the indiscriminate use of snowmobiles is contrary to the welfare of the Band Members. Now Therefore, the Council of the Stony Rapids Band of Indians enacts as a by-law thereof as follows: 1. In this By-Law (a) "the community of Black Lake, Saskatchewan" means and include all those lands within the following defined limits-(i) Chicken Indian Reserve I.R. 224 (Black Lake Unconfirmed) as shown on Plan No. 55457 in Canada Lands Surveys Records in Ottawa.
(ii) Chicken Indian Reserve I.R. 225 (Unconfirmed) as shown on Plan No. 52912 in the Canada Lands Survey Records in Ottawa. (iii) Chicken Indian Reserve I.R. 226 (Unconfirmed) as shown on Plan No. 53911 in the Canada Lands Surveys Records in Ottawa. (b) "operator" means a person who uses, operates or is actually in physical control of a snowmobile; and (c) "snowmobile" means and include any vehicle which (i) is not equipped with wheels, but equipped with tractor treads and skies; or (ii) is designed and used primarily for operating over snow. No person shall operate a snowmobile within the community of Black Lake, Saskatchewan between the hours of 10:00 o'clock in the evenings and 7:00 o'clock in the morning. No person shall operate a snowmobile within the community of Black Lake, Saskatchewan, while impaired. As defined in the Criminal Code of Canada, Section 234 of the Act of the province of Saskatchewan.
4. Any person who violates any of the provisions of this by-law shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding one hundred dollars or imprisonment for a term not exceeding thirty days, or to both fine and imprison ment.
