(ii) Second and subsequent offences will result in a seizure and impoundment for ninety (90) days. 12 (3) Only an Officer within the meaning of this by-law may utilize subsection (2). 12 (4) Motorcycles, all terrain vehicles and or snowmobiles that are seized pursuant to subsection 12 (2) will be impounded at the RCMP Detachment and/ or Scott's General Store in Stony Rapids. 12 (5) Any outstanding impoundment fees will have to be paid before the motorcycle, all-terrain vehicle and or snowmobile can be released back to the owner." WHEREAS Section 81, Subsection 1, Paragraphs (b) (q) and (r) of the Indian Act empowers the Council of Black Lake First Nation to pass by-laws respecting the regulation of traffic, with respect to any matter arising out of or ancillary to the exercise of powers under Section 81 and to impose a penalty for the violation of a by-law made under Section 81; AND WHEREAS the Council of the Black Lake Fist Nation did enact by-law number 06/97 /03 on the 31st of January,2000 respecting the usage of motorcycles, all-terrain vehicles and snowmobiles within the Black Lake Reserve No. 224, No. 225 and No. 226; AND WHEREAS the said Council deems it to be expedient and in the best interest of the residents of the Black Lake First Nation to amend the said by-law; NOW THEREFORE the Council of the Black Lake First Nation amends the by-law thereof as follows: Paragraph 2 of by-law number 06/97.03 is hereby amended by changing the definition of "Officer" to: "Officer" means RCMP officer, any peace officer, Justice of the Peace, police constable or bailiff employed for the preservation and maintenance of the public peace or the service or execution of civil process with respect to maintaining law and order on the reserve.
