f - —% ONEIDA OF THE THAMES BAND By-law No. 11 f * - ------ - ----------.ne Oneida Band Council pursuant to Sec. 81 S.S. (e) of the Indian Act R.S.C. 149 SI enacts as follows: Any person in possession of a dog or who shall harbour or allow a dog to remain about his house or premises shall be deemed the owner o f such dog for the purpose of this by-law. Definitions: 1. (a) "Dog" means any dog, male or female. (b) "Registration Officer" - person appointed by Oneida Band Council to reg ister and tag dogs. (c) "Kennel" means a properly b u i lt cage of fencing material to hold dogs. 2. (a) Registration of a dog w ill include: - owners name - dogs name - age of dog - weight & height of dog - outstanding markings (description) - tag # - sex of dog (b) Registration tags shall be issued yearly by the Registration O fficer. (c) After deadline of reg istration, a grace period of 10 days w ill be allowed to register a dog. (d) A ll registered dogs be required to have necessary innoculattons for distemper, rabies, etc. 3. Every home will' be allowed two dogs. (a) outside watch dog (b) inside house trained pet dog (c) or both. 4. All b iting dogs -(a) w ill be leashed (b) for which a complaint has been received, shall be chained. 5. For the purpose o f raising dogs, a kennel shall be provided by the operator. 6. The enactment of this by-law shall provide for the following protection (a) a vicious dog regulation (b) to allow police o ff icers to shoot on sight a dog which is in the process of ( i) attacking human beings ( i i ) or frothing (distemper) at the mouth (c) trespassers who may be just dropping pets o f f on the settlement (d) of a Band member having to protect his property from vicious dogs, with proper accountability to the registration o f f ic e r (e) a registered owner having to dispose of a l i t t e r within a 10-week period. 7. Dogs trave lling in packs w ill be prohibited on the Oneida Settlement. 8. Disposing of sick or disabled dogs. (a) Oneida Police only, w ill have authority to shoot dogs. (b) Registered owner w ill be contacted to authorize decision (c) Deceased animals found on public property shall be disposed of by Oneida Roads department. 9. The registered owner of a dog shall be responsible for the dogs action. 10. The inhumane treatment of a dog w ill be prohibited "inhumane" adj. not humane, unmoved by the suffering of others; unfeeling, unkind, etc. (Websters New World Dictionary). 11. Penalties: (2) F a il in g to comply w ith the Dog By-Law r e g is t r a t io n procedures*, w il l r e s u lt in the dog impounded and Humane S o c ie ty ru le s w il l a p p ly.

(b) Harbouring unregistered dogs shall be an offense under this by­ law and shall be liab le summary conviction to a fine of $25.00 (twenty-five dollars) plus court costs or 10 days in j a i l or to both fine and imprisonment upon conviction. (c) Strays and/or Packs: Failure of the registered owner to comply with the requests of the Police or Registration O fficer w ill result in the dog being impounded and Humane Society rules w ill apply. 12. The empowerment and authorization of a Band Council to enact this by-law is taken from Sec. 81 SS (e) and (q) of the Indian Act R.S. C149 Sec. 1.
