SOR/ The Spanish River Band Of Ojibways By-Law 80-1 A BY-LAW TO REGULATE AND CONTROL LITTERING OF PUBLIC ROADS AND OTHER PUBLIC PLACES WHEREAS paragraphs (A), (B), (D) and (R) of Section 81 of the Indian Act empower the council of the band to make by­ laws to regulate and control littering of public roads and other public places, except in a designated area provided for that purpose, and to impose a penalty for the violations thereof; AND WHEREAS subject to R.S.O. 1970, c 202, s.124 of the Highway Traffic Act empower the council.of the band to make by-laws pursuant to Band Council Resolution 80-06-412 for the Incorporation by the Band Council of the Highway Traffic Act and Amendments thereto; AND WHEREAS it is deemed to be expedient for the benefit of the inhabitants of the Reserve of the Spanish River Band of Ojibways to regulate and control littering of public roads and public places; NOW THEREFORE the council of the Spanish River Band Of Ojibways enacts as a by-law, thereof as follows: 1. In this by-law, a. "Council" means the council of the Spanish River Band Of Ojibways which is a Band Council as defined in the Indian Act. b. "Reserve" means the tract of land set apart by Her Majesty within the definition on the Indian Act, for the use and benefit of the Spanish River Reserve Band of Indians known as the Spanish River Band Of Ojibways. c. "Road" includes any roadway, bridge, drive­ way, street, lane or other place set aside for, used, or open to the public for the passage of vehicles within the Reserve. d. "Public Place" includes any place to which the public have access as of right or by invitation, expressed or implied. e. "Sign" or "Traffic Signs" means a sign, warning, marking or other device for the guidance or direction of persons using the roads. f. "Peace Officer" includes a) a member of the Royal Canadian Mounted Police, b) a Special Constable appointed for police duty on a Reserve for the preservation and maintenance of the public peace,or for the service or execution of civil process,or any officer appointed for enforcing or carrying out the provisions of the Indian Act and the Highway Traffic Act of Ontario. The design, dimension and the erection of traffic signs shall meet the standard re­ quirements indicated in the "Manual Of Uniform Traffic Control Devices For Canada", 2nd edition, 1966, as amended, and as proposed by the council on Uniform Traffic Control Devices For Canada and the Canadian Good Roads Association. The Council shall, by Band Council Resolution, authorize the placing of all traffic signs and the Resolution shall specify the location of the sign. No person shall interfere with or attempt to interfere with the placement or maintenance of any authorized traffic sign. No person shall remove, deface, obliterate, alter or attempt to remove, deface, obliterate, or alter or in any manner interfere with any sign lawfully placed on the roads of the said Reserve. No person shall throw or deposit or cause to be deposited any glass, nails, tacks or scraps of metal or any rubbish, refuse, waste or litter upon, along or adjacent to the roads of the Reserve, except in receptacles provided for that purpose. No person shall throw or deposit or cause to be deposited any glass, nails, tacks or scraps of metal or any rubbish, refuse, waste or litter upon the public place of the said Reserve, except in a designated area provided for that purpose. Any person who violates any of the provisions of this by-law shall be guilty of an offence, and shall be liable on summary conviction to a fine not exceeding one hundred dollars or imprisonment for a term not exceeding thirty days, or both fine and imprisonment.
