The Lake Helen Volunteer Fire Department shall be referred to as the Department for the purpose of these regulations. 3. The Department shall consist of one(l) Fire Chief, one(l) Fire Station and one (1) Deputy Fire Chief and three (3) Captains, one (1) for each station and not less than nine (9) volunteer fire fighters, the above will constitute the chain of command for the Department. 4. Every member of the Department shall: a) be required to pass a medical examination prior to being accepted as volunteer firemen; b) be required to pass a medical examination once every year thereafter. Medical examinations will be the expense of the Lake Helen Band Council; c) be at least eighteen (18) years of age and not more than sixty (60) years of age. 5. a) The Fire Chief shall be appointed by a resolution, passed in Council, and shall hold office until such time as the said resolution is rescinded. b) The Fire Chief shall require every application for appoint­ ment as a Fire Fighter to be in writing on forms to be supplied by the Council. The Fire Chief shall examine every application and forward it to the Band Council with his recommendations. All officers and Fire Fighters may. be appointed upon recommedation by the Band Council and shall serve a probationary period of not lëss than six (6) months before permanent appointment can be considered. 6. The Fire Chief may suspend any member of the Department for the following: a) insubordination b) inefficiency c) gross misconduct d) repeated failure to attend practices or fires. The Fire Chief shall refer such suspension to the Band Council together with his report and recommendation, for such action as it may deem advisable. 7. a) The Fire Fighters shall respond promptly to all fire alarms in each station in area of fire on the Lake Helen Indian Reserve, and attend all scheduled practices and obey all orders and instructions of their officers, b) The Lake Helen Volunteer Fire Department shall respond to any fire calls to a municipality, or any municipality with which an agreement has been entered into, to provide fire protection on a mutual aid basis. 8. The Fire Chief shall: a) have full responsibility of the conduct and general opera tion of the Department, including fighting a fire, respond ing to a fire alarms, drills or practices, care and maintenance of the Fire Halls and all apparatus, equipment and supplies; 2
ï J y -Law #2 - cont. * P a g e 2 8. fa) N i o n . hi 3 s ab a o b v s e c en i s n e t , o a p c ut t io t n h ; e chain of command mentioned in c) regularly inspect for fire hazards, all manufacturing and mercantile premises, churches, schools, institutions, public buildings and places of assembly, and on request, inspect residences and designate any qualified officer or fire fighter as Fire Prevention Inspector, to assist in such duties; d) maintain a record of every fire call and every fire report­ ed to the Department that occur while on duty, to the admini­ strative secretary of the Lake Helen Band Council and the said secretary to forward a detailed report of such injury ? on the prescribed form to the Workmen's Compensation Board. 4 9. The Department shall meet at least once a month under the supervision of the Fire Chief for practice and instruction in the use of all apparatus, equipment and supplies of the Depart­ ment and in the principles of fire fighting, fire prevention, fire protection and first aid to the injured. A standard training syllabus shall be established using the text books of the International Fire Service Training Association. 10. The Department may: a) organize for social purposes, events intended to further the interests, welfare and morale; b) subject to the approval of the Lake Helen Band Council, have use of the Fire Hall at any convenient time for the transaction of business or for social functions. 11. The officer in charge at any fire may cause any fence or any out structure to be removed or torn down, if such removal or tearing down is necessary to prevent the spread of fire. 12. No rule or regulations of any organization shall in any way limit or diminish the authority of the Fire Chief in the per­ formance of his duties. 13. No person shall impede, interfere with or hinder any officer or fire fighter in charge of his duties at a fire, in respond­ ing to a fire alarm or at a practice, and no person shall put to any use not authorized by the Fire Chief, an apparatus, equipment and supplies. 14. Any person contravening any provisions of this Resolution shall, upon conviction be liable to a fine or internment or both. 15. In case the provisions to this Resolution conflict with the provisions of any other Resolution, the provisions of this Resolution shall prevail. 16. These regulations or policies shall be subject to change periodically when deemed necessary with the approval of the Lake Helen Band Council. 17. All provisions of this By-Law apply equally to all persons residing within the territorial confines of Lake Helen Reserve 53A. 3
