DAY OF . 1997 WHEREAS: A. Subsection 81(1), (d). (q) and (r) of the Indian Act, R.S., 1985, c. empower the Council of a First Nation to make by-laws for regulating and control of dogs, matters ancillary to the exercise of this power, and penalties for violation of these by-laws; and B. The Council of Rainy River First Nations that the prevention of regulating and control of dogs shall assist in promoting the comfort and safety of the residents of our Reserve. NOW THEREFORE the Council of the Rainy River First Nations enacts the following by-law; 1. Short Title This by-law may be cited as the Dog By-Law". 2. Interpretation In this by-law: a) All dogs, within the area of the Rainy River First Nations, must carry an identification tag within one (1 ) week of the coming into effect of this by-law; b) The Rainy River First Nations Administration Office will give out identification tags and maintain registry books for any dog within the Rainy River First Nations Territory; c) A household or family will obtain an identification tag(s) from the Rainy River First Nations Administration Office within one (1) week of acquiring a dog. d) No household will be permitted to have more than two (2) dogs. e) Dogs are to be tied at ail times, with the exception of times when they are on a leash and under control of the owner. ........... H'JI rrc unluhn HM-H1KS THBflY 807 623 7021 TD 18199970034 P.03/03 -2 f) Owners of those dogs found at large will be given one warning by the Rainy River First Nations Constables to secure their dog or dogs. g) Dogs found running at large will be impounded for a period not to exceed 72 hours. Owner of any dog or dogs Impounded will be required to pay $10.00 per day in order to have dog released. Dogs impounded after 72 hours will be destroyed. h) Dogs that are kept outdoors must be provided with a proper shelter. i) Households acquiring female dogs must have the animal spayed unless toe dog has been acquired for breeding purposes and exemption has been granted by Council. j) Any dog who malicious bites or attacks a person, within toe Rainy River First Nations Territory, win be quarantined for a period of 14 days then destroyed. This does not include those animals who are confined in toeir owner's yard. 3. Penalty Any person who violates any of toe provisions of this by-law shall be guilty of an offence, and shall be liable to a summary conviction to a fine not exceeding one thousand dollars ($1,000.00) or imprisonment for a term not exceeding 30 days or both.
