P A R U £ S PRESENTERS" THAT, we enact as a by-law of the Big Cove Indian Band pursuant to Section 81 of the Indian Act. R.S.C., C. 1-5, the following: FIRST NATIONS LAW NO. FIRST NATION AT BIG COVE WHEREAS paragraphs (c), (d), (h) and {r) of Section 81 of the Indian Act empower the Council of a Band to make by-laws respecting the observance of law and order, the prevention of disorderly conduct and nuisances, and the regulation of the use of buildings owned by the Band, respectively, and the imposition of penalties for violations thereof; NOW THERFORE, the Council of the Big Cove Indian Band enacts as a by-law the following: A FIRST NATIONS LAW TO PREVENT PETTY TRESPASSES AND LOITERING IN PUBLIC PLACES ON THE BIG COVE RESERVE. 1. In this by-law: "authorized person" means an occupier or possessor of premises; "loiter" means to hang idly about a place; "occupier" means (a) a person who is in possession or control of premises; and (b) school personnel including teachers, chief administrative officers and other administrative personnel, school building maintenance personnel, secretaries, persons other than teachers engaged to deliver or to assist in

No person shall loiter in a public place and in any way obstruct persons who are in that place. 4. Any person who violates any of: the provisions of this by-law is guilty of an offence punishable on summary conviction and is liable: (a) for the first offence to a fine of not less than twenty- five dollars and not more than two hundred dollars and in default of payment to imprisonment for a term not exceeding ten days; (b) for a second or subsequent offence in relation to the same premises or public place to a fine of not less than one hundre4 dollars and not more than one thousand dollars and in default of payment to imprisonment for a term not exceeding thirty days. r r v ; 0
