ESKASONI BAND CF INDIANS BY-LAW 4-79 Being a By-law to provide for the control of damage to premises and/or property at the Eskasoni Federal School (s); Whereas paragraph (c) of section 81 of the Indian Act empowers the Council of a band to make by-laws respecting the observance of law & order and the imposition of a penalty for the violation thereof; and whereas it is deemed to be necessary for the control of damage at the Eskasoni Federal School (s) . Therefore, the Council of the Eskasoni Band enacts as a by-law the following: 1. In the By-Law: (a) council means the council (as defined in the Indian Act) of the Eskasoni Band of Indians. (b) school & shall mean that building situated on lots 8,9,10,11,12, & 13; Survey Plan 59238; (c) grounds shall include all that land which is defined in section (b) herein. (d) motorized vehicle shall include any vehicle or means of transportation which is propelled by any driven engine, e.g. (cars, trucks, tractors, motorcycles, mcpeds, snowmobiles) and shall specifically exclude any vehicles being used for the maintenance or repairs of said grounds. 2. No person, at any time shall cause any motorized vehicle to be driven on any part of the school grounds that are not paved unless, excluded in section (d) herein. 3. No person shall be at the school or grounds unless, on specific Legal business or activity between the hours as hereinafter stated: (a) April 15 - October 15 inclusive; one hour before sunrise and one hour after sunset; (b) October 16 - April 14 inclusive; one half hour before sunrise and one half hour after sunset. 4. Any person violating the preceding sections shall be liable upon summary conviction before a judge to a penalty not exceeding one hundred dollars, or imprisonment for a term not exceeding thirty days, or both, as provided in Section (r) for a violation against section 81 of the Indian Act.
