WALPOLE ISLAND INDIAN RESERVE #46 WALPOLE ISLAND, ONTARIO BY-LAW # 24 TITLE A By-law relating to the charge of occupants of lands on the Walpole Island Indian Reserve who are not members of the band or body of the Indians in respect of certain services provided by authority of the Walpole Island Council. PREAMBLE WHEREAS the Walpole Island Council has authorized the provision of certain services on the Walpole Island Indian Reserve including services to provide for the health of the residents; regulation of traffic; observance of law and order; construction and maintenance of water courses, roads, bridges, ditches, fences and other local works; the construction and regulation of the use of public wells and other water supplies; the preservation, protection and management of fur-bearing animals, fish and other game on the reserve and the removal or frequenting the reserve for proscribed purposes; and WHEREAS said services provided to persons who are members of the Walpole Island Band and to persons who are occupants of lands on the Walpole Island Reserve under lease from Her Majesty the Queen in the Right of Canada who are not members of the band or body of the Indians; and WHEREAS said lands under lease ceased to be liable to taxation under the Assessment Act RSO 1970 Chap. 32 by virtue of the provisions of Section 1 (1) of the Assessment Amendment Act, 1973 Statutes of Ontario 1973, Chap. 26; and WHEREAS the said occupants have not been taxed in respect of said lands since January 1, 1973; and WHEREAS it is decided to make a charge to occupants of lands on the Walpole Island Reserve who are not members of the band or body of the Indians in respect of the abovementioned services inasmuch as said occupants are not liable to taxation as aforesaid. NOW THEREFORE in pursuant to the authority of Section 83-1-b of the Indian Act, the Council of the Walpole Island Band enacts as follows: ENACTMENTS 1 The Walpole Island Band, through its trustee, Her Majesty the Queen in the Right of Canada, shall make a charge to occupants of lands on the Walpole Island Reserve under lease from said trustee who are not members of the band or body of the Indians, for each annual term commencing May 1, 1979 as follows: (a) i) Occupants of a lot or lots used for recreational purposes:- Ü ) $150. per annual term plus $75. per annual term for each lot in excess of one (1) lot. iii) If payment is received at this office on or before the due date of June 1, 1979 a discount of twenty-five ($25.) dollars will be allowed for the first lot only. (b) i) Occupants of a lot or lots used for agricultural purposes:- Ü ) Two dollars ($2.) per acre/per annual term. (c) i) Occupants of a lot or lots used for hunting purposes:- Ü ) One Dollar ($1.) per acre/per annual term. 2. The annual term for such charge shall be from May 1, in each year, to April 30, in the following year, commencing May 1, 1979. 3. Notice of such charge shall be mailed to each such occupant be prepaid post and such charge shall be payable to the Walpole Island Council, R. R. #3, Wallaceburg, Ontario, thirty days after the date of mailing of such notice. Approved and passed at a duly conducted meeting of the Council of the Walpole Island Band of Indians this 9th day of April, 1979. CONT. . . 2
