TEMAGAMI FIRST NATION BYLAW NO. 2006-002 RE: ELIGIBILITY TO VOTE ON TAKING CONTROL OF MEMBERSHIP AND PROPOSED MEMBERSHIP CODE Being a bylaw respecting eligibility to vote on taking control o f membership and on a proposed Membership Code. WHEREAS the Temagami First Nation Tribal Constitution states that only members resident on tribal ancestral hunting lands may vote as electors in First Nation elections; AND WHEREAS section 81(1), subparagraph (p.4) of the Indian Act, R.S.C. 1985, c.I-5, as amended, empowers the Council of the Temagami First Nation to pass a bylaw to bring section 10(3) of the Indian Act, R.S.C. 1985, c. 1-5, as amended, into effect in respect of the First Nation; AND WHEREAS section 10(3) of the Indian Act, R.S.C. 1985, c. 1-5, as amended, if brought into effect in respect of a First Nation, requires that First Nation consent to taking control of membership and to a proposed Membership Code shall be given by a majority of the members of the First Nation who are the M l age of eighteen years; AND WHEREAS the Council of the Temagami First Nation acknowledges that all members of the Temagami First Nation have an interest in how the First Nation determines its membership; AND WHEREAS the Council of the Temagami First Nation believes that it is necessary to ensure that all adult members of the Temagami First Nation are provided with the opportunity to vote on taking control of membership and on a proposed Membership Code; NOW THEREFORE the Council of the Temagami First Nation in the Province of Ontario makes as a bylaw thereof as follows Section 10(3) of the Indian Act in Effect 1. Section 10(3) of the Indian Act, R.S.C. 1985, c. 1-5, as amended, shall come into effect with respect to the First Nation for the purpose of voting on: (a) whether the First Nation consents to assuming control of its own membership; and (b) whether the First Nation consents to establishing membership rules, including a mechanism for reviewing decisions on membership, as set out in the proposed Membership Code.
