PAR LE8PRESENTE6: WHEREAS section 81, paragraphs (1 ) (g), (h), (q), and (r) of the Indian Act empower the Council of the Band of Indians to pass by-laws to provide for the regulation of the use of lands, buildings, and structures on the reserve, the regulation and control of residential, commercial, and industrial development, matters arising out of or ancillary to the exercise of powers under this section, and the imposition of a penalty for the violation of any such by-law; AND WHEREAS the Council of the Mississaugas of the. Credit Band did enact By-law Number 2012-03 respecting Zoning; AND WHEREAS the said Council deems it to be expedient and in the best interest of the residents of the Mississaugas of the Credit to approve a Site Specific Amendment to -said By­ law;. AND WHEREAS the Council of the Mississaugas of the Credit held a public hearing pursuant to the Applicants Guide for Requesting Amendments to the Mississaugas of the New Credit First Nations Zoning By-law on June 16, 2014; AND WHEREAS the applicant agreed to follow health & safety standards currently enacted for the proposed development; NOW THEREFORE the Council of the Mississaugas of the Credit Band approves and enacts a Site Specific Amendment to By-law 2012-03 as follows: 1. That the Mississaugas of the New Credit Chief and Council hereby allow Lawrence Bice a Site Specific Amendment to Lot 6-21 Concession 2 Tuscarora Township, to allow for the development and operation of a Gasoline Station and Convenience Store under Zoning By-Law 2012-03. The property is currently zoned as RU Rural Residential and has been rezoned as C1, Commercial Zone pursuant to Section 9.0 of Zoning By-law 2012-03.
