Ma^Cbn Falls Indian Reserve #65 By-law #8 Being a by-law to control the prohibition of intoxicants on the Marten Falls Indian Reserve #65. Whereas a majority of the electors of the Band voted in a referendum on November 27, 1985 in favour; of the Indian Act provisions regarding the prohibition of intoxicants on reserves; and, Therefore in pursuance to the provisions of the Indian Act sec. 85.1 the following by-law to come into force on December 28, 1985 and thereafter is hereby enacted. 1. Etef_imj^ons (a) "Intoxicants" means as defined in the Indian Act sec. 2 (1). (b) "Reserve" means the Marten Falls Indian Reserve #65. (c) "Everyone" means everyone that resides within the boundaries of the reserve and outsiders who enter the reserve for any reason. 2. Prohibition on Sale, Barter, Supply, or Manufacture Everyone who sells, barters, supplies or manufactures intoxicants on the reserve is guilty of an offence liable on summary conviction to a minimum fine of three hundred dollars and to a maximum fine of one thousand dollars or to a minimum term of three months imprisonment and to a maximum term of six months imprisonment or to both. 3. Prohibition on Intoxication Everyone who is intoxicated on the reserve is guilty of an offence liable on summary conviction to a minimum fine of fifty dollars emdttx>aa;‘39aasdmimtfiiieoôfoc»e hundred dollars or to a minimum term of one month imprisonment and to a maximum term,of three months imprisonment or to both. \ 4. Prohibition on Possession of Intoxicants Everyone who is in possession of intoxicants on the reserve is guilty of an offence liable on summary conviction to a minimum fine of fifty dollars and to a maximum fine of one hundred dollars or to a minimum term of one month imprisonment and to a maximum term of three months imprisonment or to both. 5. Adhesion, Delesion, or Revision In this by-law no provision may be added thereto, deleted therefrom, or revised thereof without the consent of the majority of the electors of the reserve.
