^ I MARTEN FALLS INDIAN RESERVE NO. 65 OGOKI By-Law #8 Section 81 (q) Without Prejudice Being a "by-law to control the threat of forest fires and to en force "the Forest Fires Prevention Act". Whereas, under Section 81 (Q) of the Indian Act, the Council of the Band empowered to make by-laws to provide protection of per sons & property against fire hazards, And whereas, numerous fires have been set deliberately on the reserve, Therefore, the Band Council of the Marten Falls Band of Indian enact as a by-law there of the following. 1) In this by-law; (A) Council means the Marten Falls Band of Indians as de fined in the Indian Act. (B) Reserve means Marten Falls Band Reserve #65 as agreed in the James Bay Treaty. (C) Fire Hazard means the use of matches,outdoor fires, smoking, or careless use or disposal of flamable ma terials, (D) "The Forest Fire Prevention Act" means regulations made under the Act. RSO 1970, c 179f s.l; 1974, c 22, s.l. 2) Ho resident or visitor, status or otherwise, shall, within the boundaries of the Marten Falls Reserve, use carelessly çr without adequate reason any combustible materials that might endanger the lives & properties of the residents of the Marten Falls Reserve. 3) All residents and visitors of the Marten Falls Reserve shall \ henceforth become, or be made aware of "She Forest Fires Pre vention Act" and shall be subject to the regulations and ’ penalties of the said Act.
Any person who violates any of the provisions of this by-law shall be subject to Section 34 of the Forest Fires Preven tion Act and shall also be guilty of and offense and shall be liable upon summary conviction to a fine not exceeding one hundred dollars or to imprisonment for a term not ex ceeding thirty days, or to both fine and imprisonment.
