Till', CARDEN RIVER BAND OF OJIBWAYS by-law NO.: 12 _ section 81 (m) Indian Act Being a By-law to authorize the carrying on of a community program of Recreation within the mean­ ing of the regulations under the Ministry of Tour­ ism & Recreation Act and to provide for the estab­ lishment, operation and maintenance of community centres . 1. The Council of the Band enacts as follows: (a) Pursuant to Regulations made under the Ministry of Tourism & Recreation Act, a community program of Recreation is hereby established for the resi- ents of the Reserve. (b) The said community program of Recreation, and the said community centres shall be directed, managed and controlled on behalf of the Council the Band by a committee known as the Garden River Recreation Committee. 2. The Committee shall be appointed by the Council of the Band as follows: (a) Two (2) members of the Council of the Band. (b) Ten (10) residents of the said Reserve who are qualified to be elected as members of the Committee. COMMITTEE APPOINTMENT 3. The said Committee shall be composed of twelve (12) members, two (2) of whom shall be members of the Band Council. The Committee shall be appointed by and the terms of office, its members, shall be established by the Council of the Band. 4 . The said Committee shall consist of twelve (12) members ap­ pointed by resolution of Council, all of whom shall be resi­ dents of the Reserve and two (2) of whom shall be members of the Band Council. Appointment of Council members shall be for a three-year (3) term and the non-Council members, a two- year (2) term . 5. The appointment of the said Committee should be made annually at the first regular meeting of the Council, or as soon there­ after as is expedient. The members shall hold office until their successors shall be been appointed, provided that all members shall hold office during the pleasure of the Council of the Band. ADMINISTRATION 6. Subject to the approval of Council, the said Committee shall formulate policies, rules and regulations for and relating to the administration of community programs of Recreation. 7. The said Committee shall hold regular monthly meetings. 8. At any meetings of the said Committee, a quorum shall consist of a minimum of seven (7) members. (1/2 + 1 member of Committee) 9. The said Committee shall recommend a Chairman annually from among its members and such other officers as may be required. 10. The said Committee may appoint as it deems necessary such committees to act in an advisory capacity to the Committee. Cont1d
ADMINISTRATION CONT'D 11. In carrying out the provisions of this By-law, the said Committee shall at all times by the agent of the Band Council and while acting bona fide within the limits of the authority this By-law, neither the Committee nor any member thereof shall incur any liability by reason of anything done or left undone by the Committee; provided however, the nothing in this paragraph contained shall authorize or empower the Com­ mittee to incur any debt, liability or obligation for which the Band Council shall become liable without having previously obtained the consent of the Council of the Band. FINANCE 12. On or before the first day of May each year, the said Committee shall submit to the Band Administrator for audit, a statement of its financial affairs for the preceding fiscal year and to the Council of the Band full and complete annual and other reports as required . 13. On or before the first day of January each year, the said Committee shall submit and interpret to the Band Council, a detailed estimate of its budget requirements for the then current year . 14 . The Council shall establish a ledger account on behalf of the said Committee to be known as the "Recreation Committee Account". (a) The signing officers for the Bank Account shall be the signing officers of the Garden River Band of Ojibways as appointed each year. (b) The ledger account of the said Committee shall be kept by the Band Administrator. 15. No debt or obligation exceeding the authorization level of the Band Administrator shall be incurred by the said Committee and no payments shall be made by or on behalf of the said Committee unless duly authorized by resolution of the Council. 16. The said Committee may recommend fees for participating in or admittance to any part of the community program of Recreation or facilities used. Subject to approval of Chief and Council. 17. The said Committee may solicit or receive any gifts or bequests of money or services of any donations to be applied principal or income for either the temporary or permanent use for facili­ ties, equipment, program or other recreational purposes. The balance in the Recreation Program at the end of each fiscal year must be deferred to each new fiscal year . All surplus dollars must be retained within the Band's recreation account. PROGRAM & FACILITIES 18. The said Committee shall conduct or encourage and assist the programs of Recreation which will meet the needs and interests of the inhabitants of the Reserve . Such programs shall include the social, cultural, and physical aspects of Recreation as applied to each age group, both male and female. 19. The said Committee shall operate, maintain and manage on behalf of the said Band, all properties which are now or which may hereafter be established as community centres . STAFF & PUBLIC RELATIONS 20. Subject to the approval of Council, the said Committee may recommend a qualified and competent Director of Recreation, a Secretary for the said Director and such assistants or other personnel as may be required to carry out the directions of the said Committee, and such persons when appointed or engaged with the approval of Council shall be the employees of the Band. The said Committee shall at all times keep the inhabitants of the Reserve aware of the recreation opportunities which are available and will continually interpret to the inhabi­ tants the total community program of Recreation. 22. In carrying out the provisions of this By-law, the Committee shall at all times be the agent of the Garden River Band of Ojibways and while acting bona fide within the limits of the authority of this By-law, neither the Committee nor any mem­ ber thereof shall incur any liability by reason of anything done, or left undone by the Committee, provided however, that nothing in this paragraph contained, shall authorize or em­ power the Committee to incur any debt, liability or obligation for which the Garden River Band shall become liable without having previously obtained the consent of the Council. The previous By-law # 1 dated January 8, 1968, is hereby rescinded.
