*/A/6 - O o/g 7 BY-LAW NO. 1997-01 of the Fort William First Nation By-law for the Prohibition of Littering W hereas the Council of the Fort William First Nation desires to make a by-law for the prohibition o f littering on the Fort William First Nation reserve, with respect to any matter arising out of or ancillary to the exercise of powers under section 81, and for the imposition of a penalty for the violation thereof; AND W HEREAS the Council o f the Fort William First Nation is empowered to make such by-law pursuant to paragraphs 81 (1) (a) fr)8>f tfSfïIruâMi 27/; A 9 *20 AND W HEREAS it is considered necessary to provide for such regulation on the Reserve for the health of the inhabitants, the prevention of diseases and nuisances and for the overall appearance of the Reserve; NOW THEREFORE the Council o f the Fort William First Nation hereby makes the following by-law: Short Title 1. This By-Law may be cited as the For/ William First Nation Littering By-Law”. Interpretation 2. In this By-Law, CounciF means the Council o f the Fort William First Nation; "Hitter" includes any material left or abandoned in a place other than a receptacle approved by the Council for receiving such material and littering has a corresponding meaning. reserve means the reserve of the Fort William First Nation and includes the Reserves No. 52 Littering Prohibited 3. No person shall abandon any material in a place, manner, receptacle or wrapping such that it is reasonably likely that the material will become litter. Disposai of Garbage 4. No person shall discard or dispose of or deposit garbage anywhere on the reserve except in such places and at such times and under such conditions as the Council may authorize. Offence 5. Every person who fails to comply with a provision of this by-law commits an offence. Penalty 6. A person who commits an offence under this by-law is liable on summary conviction to a fine not exceeding $1,000.00 or to imprisonment for a term not exceeding 30 days, or to both. THIS BY-LAW IS HEREBY MADE at a duly convened meeting of the Council of the Fort William First Nation this 25th day of June, 1997.
