FORT WILLIAM BAND OF INDIANS BY-LAW NO. 20 Being a by-law to restrict the use of certain lands. WHEREAS paragraphs 81(1)(a), (g) and (r) empower the Council of a Band to make by-laws to provide for the health of residents on Reserve, to prevent the spreading of diseases, to divide a portion of the Reserve into zones and prohibit certain uses and construction therein, and to impose a penalty for the violation of a by-law; AND WHEREAS the Council desires to co-operate with other local Governments to protect the on-reserve source of the public water supply of such localities; NOW THEREFORE the Council of the Fort William Band of Indians makes a by-law thereof as follows; This by-law peratins to area commonly known as the Loch Lommond Watershed on the Fort William Reserve. The Watershed area contains land of approximately a 200 foot radious around the Loch Lommond Lake. The area is specified as Appendix "A", on map of Loch LOmmond Watershed. 1. In this by-law: (a) "Council',1 means the Council, as defined in the Indian Act, of the Fort William Band of Indians; (b) "business, trade or calling" for greater certainty includes, but is not limited to, any. form of Agricultural or forestry pursuit or activity related thereto; (c) "enviornmental protection area" means and includes all those portions of the Reserve lying within two hundred (200) feet of the high water mark of any body of water situated within the Reserve or contiguous to the limits of the Reserve: 2
Fort William Band of Indians by-law -# 20. 2/4 (d)"Reserve" means those lands, the legal title to which is vested in Her Majesty, that have been set apart by Her Majesty for the use and benefit of the Fort William Band of Indians and usually referred to as the Fort William Indian Reserve No. 52; and (e) "waste' includes garbage, liquid and semi-liquid substances, land fill and scrap of all kinds and any combination of any of the foregoing. 2. Within the environmental protection area no person shall: (a) construct or maintain any buildings or carry on any class of business, trade or calling; or (b) cut down, log, remove or otherwise destroy the trees; or (c) deposit waste. 3. (1) The Council shall post, or cause to be posted, notices advising of the existence of the by-law and its general provisions. (2) Such notices shall be posted: (a) at least 500 meters along the limits of the environmental protection area; and (b) at the entrance to the environmental protection area of any road or commonly used foot path leading to that area. 4. No person shall remove, damage or destroy, or cause to be removed, damaged or destroyed, any notice posted by or on behalf of the Council pursuant to this by-law. 3

Any person who violates any provision of this by-law shall be guilty of an offence and shall be liable, on summary conviction, to a fine not exceeding one thousand dollars or imprisonment for a term not exceeding thirty days or to both a fine and imprisonment.
