This By-Law to be known as No. 80 - 13. WHEREAS the Indian Act enacts as follows: An annual Dog Tax̂ shall be levied in Rama Indian Reserve No. 32 upon every person who is assessed as owner or tenant of any land who is in occupation thereof in respect of every dog that he owns in the Rama Indian Reserve No. 32 or that is habitually kept upon the premises although the dog may by owned by some other person. THEREFORE the Council of the Chippewas of Rama Reserve No. 32 enacts as follows: 1. (a) "Dog" means a male or female, over the age of 12 (twelve) weeks; (b) "Owner" of a dog includes any person who possesses or harbours a dog and 'owns* or 'owned' have a corresponding meaning. 2. Every owner of a dog shall, on or before the 15th day of March in each and every year, or upon becoming the owner of a dog after the 15th day of March, register such dog with the Chippewas of Rama Band Administration Office, and procure a licence and dog tag for each dog owned by him. 3. Every dog tag shall bear the serial number and the year in which it was issued and a record shall be kept by the Band Administration Office showing the name and address of the owner and the serial number of the ----- tag-.-------A quorum for this Band 4. Every licence pursuant to this By-Law shall expire on the 31st day of December of the .year in respect of which it was issued and the licence fee to be paid to the Chippewas of Rama Band Administration Office at the time of the issuing of the licence shall be as follows: (a) For each Male Dog or Spayed Female Dog (Certificate must be produced) ............. ............. (b) For each Female Dog ...... .............................. (c) Any household having more than one dog, male or female will be required to pay an additional licence fee of .......... Notwithstanding the provisions of Section 7 above, the owner of a kennel of pure-bred dogs registered in the register of the Canadian Kennel Club Incorporated, shall pay an annual licence fee of Twenty-Five Dollars ($25.00) to the Chippewas of Rama Band Administration Office and such owner is not liable to pay any further licence fee in respect of such pure-bred dogs. Provided that the fee for renewal of a licence under the provisions of this paragraph shall be Ten Dollars ($10.00) upon renewal prior to the 15th day of March. (a) No owner of a dog shall allow the dog to cause a nuisance, or run at large within the limits of the boundaries of the Rama Indian Reserve No.32. (b) For the purposes of this section a dog shall be deemed to be running at large when found elsewhere than on the property of the owner and not under the control of a competent and responsible person. (c) Where a dog seized is injured or should be destroyed without delay for humane reasons or for reasons of safety to persons or animals, the peace officer or by-law officer may destroy the dog in a humane manner as soon after seizure as he thinks fit without permitting any person to reclaim the dog or without offering it for sale and no damages or compensations shall be recovered on account of its destruction. 11. (a) Every person who contravenes Section 9 of this By-Law is guilty of an offence and on summary conviction is liable to a fine of not less than Twenty-Five Dollars ($25.00), exlcusive of costs, and every such fine is recoverable under the Summary Convictions Act. (b) Notwithstanding the provisions of sub-section (a) of Section Numbered 11 or the provisions of Section Numbered 6 of this By-Law, any person may, upon presentation of a violation tag issued pursuant to this By-Law alleging commission of an offence under this By-Law, pay out of Court within 5 days from the date of issue of the said tag (exclusive of Saturday, Sunday, and holidays) the sum of $25.00 and upon such payment no further proceedings are to be taken under this By-Law in respect of the said offence alleged in the violation tag.
