THE BIG ISLAND BAND OF INDIANS BY-LAW # 5 . Being a by-law respecting the observance of law and order. WHEREAS Section 81 (l)(c) of the Indian Act empowers a Council of a Band of Indians to make by-laws for the observance of law and order on the Reserve and the imposition of penalty for the violation thereof: NOW THEREFORE the Council of the BIG ISLAND BAND of Indians enacts as a by-law thereof as follows: 1) In this by-law a) Council means the Council, as defined in the Indian Act, of the BIG ISLAND BAND of Indians. b) Child means any young person under the age of 18 years. c) Young person means any person who has attained the age of 18 years, but not the age of 18 years. d) Reserve means that tract of land, the legal title to which is vested in Her Majesty, that has been set apart for the use and benefit of the BIG ISLAND BAND of Indians and known as Suag-a~gaw~sing I.R. # 1. e) Pa r e n t or guardian, means that person, either natural parent, step parent, foster parent or any other person who by agreement has control of the child or young person. f) Holidays means any day when school is excused according to the school calendar at either McCrosson\ Tovell school or Rainy River High School. 8) No parent or guardian shall allow any child to remain in any public place or on any street within the community after the hour of 10.00 p.m. local time, unless accompanied by an adu1t . 3) No parent or guardian shall allow any young person to remain in any public place or on any street, unless accompanied by an adult after the hour of 10.00 p.m. local time on school night or after the hour of IS midnight on holidays and week-ends.
A) Any person who violates any of the provisions of this by­ law shall be guilty of an offence, and shall be liable on summary conviction to a fine of fifty dollars ($50.00).
