SQUAMISH INDIAN BAND ZONING AMENDMENT BY-LAW NO. 15 (SQUAMISH INDIAN BAND) (BY-LAW NO. 15,1986) A by-law to permit construction of a fitness spa at the International Plaza Hotel. WHEREAS the Council of the Squamish Indian Band has received a request from the Lessee of the lands upon which the International Plaza Hotel is situate for permission to make certain specified improvements to the International Plaza Hotel, and amendment to certain hereinafter referred to By-laws is required in order to permit any such improvement to be made; NOW THEREFORE the Council of the Squamish Indian Band at a duly convened meeting of the Council assembled on the 16th day of July, 1986, pursuant to Section 81 of the Indian Act hereby enacts as a by-law the following: 1. Squamish Indian Band Zoning By-law No. 6, 1972, as amended to July 16th, 1986 is hereby amended by adding a Section 11 thereto which provides as follows : "11. Subject to issuance of appropriate Building Permits by the Council of the Squamish Indian Band, the present Lessee of the lands upon which the International Plaza Hotel is constructed shall be permitted to make such alterations and improvements to the
2 International Plaza Hotel (which is situate on Capilano Indian Reserve No. 5) as are detailed in those plans produced by Christopher Bozyk Architects having Drawing Numbers A2 and A5 and referring to "RON ZALKO FITNESS SPA INTERNATIONAL PLAZA", as amended so as to conform with any changes thereto recommended by the Corporation of the District of West Vancouver upon reviewing the plans." Chief Philip Joe, Economic Development Officer of the Band, is hereby authorized: (a) to issue such Building Permits on behalf of the Band as are necessary to permit the alterations and improvements referred to in section 1 (the "Spa Improvements") upon being in possession of a letter from the Corporation of the District of West Vancouver ("West Vancouver") confirming that in its opinion the plans referred to in section 1 are adequate for the issuing of a Building Permit and upon payment of such relevant Building Permit fees of the Squamish Indian Band as are now in effect, (b) to make such arrangements with West Vancouver as are necessary to secure the opinion of West Vancouver referred to in paragraph (a) and in order to request inspection of the Spa Improvements by West Vancouver, and
3 (c) to withhold any approval of occupancy of the Spa Improvements until the Band has received confirmation, in a form satisfactory to Chief Philip Joe, from the Lessee referred to in section 1 that the Spa Improvements as con­ structed have been inspected by West Vancouver and that West Vancouver has confirmed to such Lessee that the Spa Improvements have been constructed in conformity with the plans referred to in section 1. 3. This By-law may be cited for all purposes as Squamish Amendment Zoning By-law No. 15, 1986.
